James Holmes Massacre

First Lawsuit

7/24/2012 9:00 AM PDT BY TMZ STAFF

James Holmes mug shotOne of the victims in the James Holmes mass murder spree has lawyered up and plans to file a lawsuit ... because he feels the theater dropped the ball in a very fatal way.

Torrence Brown, Jr. was in Century 16 Theater when Holmes let loose.  One of Brown's best friends, A.J. Boik, was shot in the chest and died.  Brown, who was not physically injured, claims to now suffer from extreme trauma.

Brown has hired attorney Donald Karpel to rep him.  Karpel tells TMZ ... he is targeting 3 defendants.

1.  The theater.  Karpel claims it was negligent for the theater to have an emergency door in the front that was not alarmed or guarded.  It's widely believed Holmes entered the theater with a ticket,  propped the emergency door open from inside, went to his car and returned with guns.

2.  Holmes' doctors.  Karpel says it appears Holmes was on several medications -- prescribed by one or more doctors --  at the time of the shooting and he believes the docs did not properly monitor Holmes.

3.  Warner Bros.  Karpel says "Dark Knight Rises" was particularly violent and Holmes mimicked some of the action.  The attorney says theater goers were helpless because they thought the shooter was part of the movie.  Karpel tells TMZ, "Somebody has to be responsible for the rampant violence that is shown today."

That's absurd. Seriously. Violence traces back to cavemen, it's part of human nature, not a comic book movie.

Someone IS responsible... His name is James Holmes. He was aware of his premeditated actions as he was carrying them out.

Torrence Brown, Jr. are a joke.

Trying to sue WB because of a movie and it's content? If you don't like the content, then DONT GO TO THE MOVIE.

To try to blame WB is a joke..and honestly WB should counter sue him to teach the lawyer a lesson.

Now, the emergency door thing definitely has merit and it was the first thing I said when the information leaked out that the movie theater is going to be sued for the ability to sneak in that way. Don't be surprised to see all movie theater emergency exits be alarmed now and that you can't exit or enter that way anymore.

Dude isn't that the reason why you paid your ticket in the first place? wow.....May be I should sue the makers of Magic Mike for making me sexually aroused. ;(

If I survived, I would be thanking God I was ALIVE........ not looking to make money off of the deaths of other people! So much for near death experiences making people realize what's really important in the world.......

He's now suffering from "extreme trauma".. it is a traumatic situation, but how the hell does he know he's traumatized??? It happened 3 days ago!! There's shock and then there's trauma. This is not trauma.. not yet! Is the sixth stage of grief greed? I was unaware of that one.

Are you freaking serious? No one twisted your arm to go and see the "violent" movie. You knew before hand the movie would be violent dumbass. You might have a small case against the theater (which I doubt) but not his doctors, and certainly not Warner Bros.

Ok, putting this terrible tragedy aside for one moment, this dude is a freaking a-hole. Sorry dude, but you don't lawyer up and claim trauma 3 days after this happened. I can't even believe someone would do this, well, yes, I can, but I hope it gets tossed. Sue the theater? They did nothing wrong. Sue Warner Brothers? Every single movies that comes out sometimes people dress up for the movie. And, his doctors? Dude, i think you need a doctor!!

This article is a good one. This guy maybe has a case with the theater but not the doctors or warner brothers.

People Annoy Me

This kid is extremely stupid. May the dead rest in peace, but he's making things so much worse :L

1. MANY theaters have an emergency exit in case if things such as fires and whatnot. If you're targeting this theater for their door, might as well target them all.

2. The doctors have NOTHING WHAT SO EVER to do with this. Holmes could easily to lie to every doctor and say "I'm on no medication" and the doctors will all drug him with something. Going after his doctors? Really?

3) This one is too stupid to even explain...I guess every movie in America should be deemed "Dangerous" now...Are you kidding me...? Is this serious or not?

Wait.. How does this guy know the movie was "particularly violent"? The shooting happened in the first fifteen minutes of the movie. Did this guy go back and watch the movie so that he could go hire some lawyers and say "yes, yes, it was violent after all, I have a case"?
