Victim's Mother Ready

to Sue Movie Theater

0729_james_holmes_aurora_tmzThe mother of one of James Holmes' massacre victims has hired a high-powered attorney to sue the Aurora, CO movie theater where he opened fire ... killing 12 people, and injuring 58 others.

TMZ has learned Shirley Wygal is retaining a lawyer in Los Angeles to handle her case -- and we're told she plans to go after the Century 16 Theater.

Shirley's 32-year-old daughter Rebecca Wingo was shot and killed in the theater.

Sources close to Shirley tell us she believes the theater's emergency exit doors should have been alarmed, or there should have been security guards posted next to them ... especially for a premiere as anticipated as "The Dark Knight Rises."

Witnesses say Holmes entered the theater through an emergency exit door and then started shooting. Authorities think he may have propped the door open earlier from inside the theater.

TMZ broke the story ... a survivor of the shooting spree is planning a similar suit, but he also intends to go after Warner Bros. and Holmes' doctors.

We've reached out to Cinemark -- the theater's corporate owners -- but no reply yet.

Holmes will be in court Monday morning to be formally charged in the massacre.

I think when you go out in public, you assume the risk. It's not an establishment's duty to predict random acts of violence in advance if the occurence. The exits are not alarmed, they're not "EMEGENCY" exits as people believe, they're JUST exists, you can exit through them after the movie

I love when people profit off the death of loved ones instead of just mourning it as a tragedy. Blame it on others instead of the actual crazy person. Maybe you can find a back ally doctor to hock the corpse at while you are being so greedy.

I'm confused. Unless it's different in America (I'm in Canada) those really aren't emergency exit doors. They're just a different exit, a quicker way for people to get to the parking lot that doesn't involve them having to walk through the busy theatre again. I am a supervisor at a theatre, and we actually force people to use those exits on super busy weekend nights because we don't want the concession/lobby area becoming too congested. So there really wouldn't be alarms on those doors anyways.

And as for security, I agree with whomever is suing - there should have been some kind of security on duty. My theatre is lucky in that it is inside the city mall, and so we always have security on duty by default. They should have had some, especially since midnight showings don't have the same amount of staff on hand as regular showtimes do.

as bad as i feel for her, you can not alarm security doors, i mean its a movie theater, has your phone very gone off during a movie, people freak the hell out. Security guards at doors?? come one now, lady listen, i feel your pain i really do but this man was going to do what he did regardless...

Stop giving this a hole publicity and calling it the massacre by his name. How about you actually give some publicity to the people who were victims. I am honestly shocked and outraged by your continuous stupidity and indecency in not only constantly showing his face but incorrectly naming the shooting with his name, everyone is calling it the AURORA theater shooting. Seriously, your lack of sympathy for the victims and constant exposure of the monster makes it seem a little like you are idolizing him and that you want him to make him famous. Don't give this guy what he wants by making him famous.

Coming from a mothers point of view, NO MONEY IN THE WORLD would ever settle the horrible feeling of losing a child. I don't even think I would be able to THINK straight after losing my child, let alone think of suing. That's horrible.
