EXCLUSIVE: Gibson Skated Twice Before

TMZ has learned that Mel Gibson has been stopped for reckless driving two other times in Malibu but he was allowed to leave without a ticket or arrest.

As TMZ first reported, Gibson was arrested on Friday for suspicion of driving under the influence on Pacific Coast Highway in Malibu -- driving 87 miles an hour. As we reported, the deputy who arrested Gibson was ordered to sanitize his arrest report to make it appear that Gibson's arrest was "without incident." In fact, The report states Gibson was abusive, violent and vulgar, and even attempted to escape.

TMZ has confirmed that approximately three years ago, Gibson was driving 74 miles per hour on Pacific Coast Highway, one mile from his house, when he was pulled over by a Los Angeles County Sheriff's deputy. Sources say Gibson avoided eye contact with the deputy during the stop and even though the deputy was suspicious of Gibson's sobriety, he let him go.

Approximately one year ago Gibson was stopped again, after driving 64 miles an hour on Pacific Coast Highway -- where the speed limit is 45. Sources say that Gibson was so cocky that he was on his cell phone the entire time he was detained by the deputy. Ultimately, the deputy decided to let him go without giving him a citation.

And there's new information about Friday's arrest.


As TMZ reported, the deputy who arrested Gibson was ordered by superiors to re-write his report and eliminate all references to Gibson's bad conduct and anti-Semitic remarks. Sources tell TMZ that Lt. Crystal Miranda told the arresting deputy that Captain Tom Martin talked to Sheriff Lee Baca who expressed concern that the explosive report might leak to the media and that it needed to be re-written in a sanitized form.

Sources say Gibson, who was pulled over early Friday morning for allegedly crossing lanes at a high speed, told the arresting deputy that he was leaving home just after 2 a.m. and heading to his brother's house. The arresting deputy found a bottle of tequila in the car, 3/4 full, in a brown paper bag. We're told that Gibson told the deputy that the bottle wasn't his but, "I've had a little bit."

We're also told that Gibson, who issued a statement over the weekend, suggesting he was not of sound mind when he uttered the anti-Semitic tirade and engaged in abusive behavior, was not in fact "out of it." Sources connected with the case tell TMZ that Gibson was drunk but was in control of his senses. At one point at the Sheriff's station, sources say Gibson was "jumping like a monkey" on a steel cage and told the arresting deputy, "I'm not going to hurt you physically. I'm gonna hurt you. I'm gonna make you lose."

We're also told that deputies at the Sheriff's station were star struck by Gibson and a number of them went to Gibson's holding cell to get a look of the star. The problem for the Sheriff's department -- there's a mounted camera in the station and the deputies can be seen fawning over the actor. Sheriff's officials have called some of the officers who were caught on tape in and warned them they might be subject to discipline.

As TMZ reported, the arresting deputy was ordered by officials to take out references to Gibson's bad behavior. We're told the altered report makes no mention of the fact that Gibson attempted to flee the scene by running to his car to escape. We're also told that the officer checked a box on the report that Gibson was "belligerent." Ironically, even though officials did not order the deputy to remove that reference, they did order him to re-write the report to eliminate all references to the supporting evidence leading the officer to believe Gibson was indeed "belligerent."

This is another example of granting intelligence to a person by virtue of charisma. It is obvious that most responders are unaware that the Catholic Church was instrumental in much of the anti-semitic verbage taught across this world. The famous Martin Luther was the writer of a great deal of anti-semitic papers; some articles on treatment of Jews in the readers homes and villages. Many newspapers and books in prewar Germany expounded the view of the Jew as one controlling the banks. And now, we all have read that this charismatic actor/director has a father who preaches the belief that the 'holocaust' did not happen. Read and learn as an individual and stop relying on your favorite celebrity/ politition to direct your mind and belief-system.

One more thing: In most states in America, comments made during an arrest by an individual who is intoxicated on alcohol or drugs are not generally able to be used against them when attempting to pursue "Hate Crime" charges, unless that person has been arrested in the act of committing a hate crime. DUI isn't a hate crime. Telling it like it is about the fucking Jews is not a hate crime, either. It's called freedom of speech. But all you worthless ethnic bastards want to take away my freedoms that my forefathers fought and died for. You want to change a constitution? Mel will be tried for DUI and any other charges related that may or may not have occured such as attempting to elude and resisting arrest. If he pays his fines and serves the legal time, then that's Mel's business, not the likes of you idiots who get a hard on thinking you're gonna put a good white man to shame for calling you out for what you really are.

Mel has just as much right to call you a fucking Jew as you do to print this crap. I'm wondering why he suddenly started ranting about Jews after being stopped for a traffic violation, it seems so unrelevant to the situation. He'd had a few to drink but he must have had some idea that the arresting officer might be Jewish to even go off in that direction. Would he have made negative comments to a black officer? If the previous times he was stopped he was let go, he was angry because this officer wasn't going to dismiss this event.

The tiny sect of the Catholic Church Mel Gibson subscribes to is not aligned with the pope and has, rightly or wrongly, been labeled anti-Semitic because of some of its doctrine. It doesn't appear that Mr. Gibson had enough alcohol in him at the time of arrest to account for his behavior. However, if he is in fact an alcoholic, it wouldn't necessarily take as much to become that impaired. Even so, it would be bizarre for a person who doesn't stereotype or discriminate among people to invoke such a hateful tirade, alcoholic or not.

My thoughts: Mr. Gibson is guilty of being an ass, which he admits and categorically apologizes for. If he is anti-Semitic despite the denials, he clearly isn't prone to overtly acting on those sentiments. While such bigotry should always be denounced, it doesn't automatically make him a Nazi, so let's hold off on that crucifixion.

Of course much of the media is exploiting the story, turning a local OWI into national news of great import, for which most blame resides with our own obsessive fascination with celebrities, gossip, glamour and glitz. I don't believe this story deserves the priority or attention it was given in the media, but Mr. Gibson is an international commodity and the appearance of previous preferential treatment by police is worth reporting.

I don't know if it is common for Sheriff's deputies there to audio- and video-tape suspects during routine OWI's, but given Mr. Gibson's speech and behavior along with his obvious capacity to hire high-priced legal talent, the officer may have felt it the prudent course of action under the circumstances. There is insufficient evidence for condemning police--who may have reluctantly released Mr. Gibson prior heretofore because of lack of just cause, despite their suspicions, or this officer, who may have just been conscientiously doing his job--of either being too lax or overzealously prosecuting Mr. Gibson. The fact that this is his second OWI indicates he is obviously not immune to arrest and prosecution. The Sheriff's questionable actions may have simply been motivated by a desire to keep the peace and out of fairness to Mr. Gibson, not for any nefarious reason. Withholding some elements incidental to the charges from the public could also have encouraged Mr. Gibson and his lawyers to refrain from fighting the OWI charge to avoid further embarrassment, thus saving time and expense for both his department and the courts. I suspect there is rather less than more to these angles, once fully explored.

The unabashed apologists reflexively making the police or the media the scapegoat instead of one's own misplaced hero worship aren't helping matters and their misguided efforts won't exonerate Mr. Gibson. I see some apologists are even ignorantly arguing people shouldn't be offended by Mr. Gibson's ugly, hateful statements, a red herring designed to twist the issue into being about Mr. Gibson's first amendment rights. First of all, nobody is seeking to remove or curtail Mr. Gibson's right to speak freely; particularly since having this kind of ignorance out in the open makes it easier to detect and defeat. Secondly, such speech should be offensive to everyone, irrespective of race or religion (e.g., I am not Jewish, regard Israel as a travesty of justice, and still find his remarks offensive). Third, to be offended by others exercise of free speech to reject Mr. Gibson's bigotry not only negates their own argument, it epitomizes hypocrisy. For those inclined to excuse or ameliorate Mr. Gibson's words because of another's bigotry, two wrongs don't make a right. The answer is to denounce all equally, just as what could rightly be called Israeli state terrorism should be treated no differently. I can't help but observe and be saddened by how many are using Mr. Gibson's defense as a surrogate defense for their own bigotry.

Mr. Gibson appears to have a problem that goes beyond his inability to consume alcohol responsibly. At best, one can only surmise his upbringing capable of trumping his intellect at times. Nevertheless, ignorance is something to be pitied, and forgiveness should be proffered if he can prove his apologies sincere by displaying a genuine willingness to admit and overcome his bigotry. Unfortunately, Mr. Gibson is apparently still in denial.
