Heather Locklear Busted

9/28/2008 1:11 PM PDT BY TMZ STAFF

TMZ has learned Heather Locklear was arrested yesterday on suspicion of driving while impaired.

Locklear was pulled over while driving in the Santa Barbara area.

Law enforcement officers tell us alcohol was not involved, but they are conducting tests to determine if Locklear was under the influence of drugs.

We're told she was released on her own recognizance, without having to post bail.

This could set up a bizarre custody battle given that Locklear and ex-hubby Richie Sambora have both been busted for similar charges.

Sambora pleaded no contest to DUI back in March -- his daughter Ava was in the car at the time he was popped. We're told Heather's kid was not in the car when she was arrested.

In June, Heather checked herself into an Arizona medical facility to fight anxiety and depression.

Heather's reps have yet to get back to us.

Thank you Karen (#56) for backing up my comment. Gosh, I wonder if we know eachother?:) Anyhow, I'm sure Heather is just having a reaction to her new meds..........sometimes meds for anxiety/depression can have the opposite effect & it sounds like she was having a major anxiety attack (been there many times & it's truly debilitating) which can fall on you at any given time without warning. It's awful & very terrifying. Lets give her a little credit for getting help for her issues.....it takes a strong person to realize that you need help & "relief" from mental anguish does not disappear overnight. Team Heather all the way.....we are all pullin' for you girl! As for all you haters, Heather is a genuine LADY...........cut her some slack!

Don't get me wrong, drunk driving is a very serious issue and should be dealt with according to the law but somehow in Hollywod, the stars get preferential treatment. How many of us, average citizens have gotten a DUI and had to serve only 15 minutes in jail, and pay a fine which to the Hollywood stars is pocket change but to us average citizens is close to 1/2 a years salary for some people. What I don't get is that if a person can sit in a bar all night that they cant put aside $30-$50.00 to take a cab home because they are too drunk to drive and why can't the celebrities get a limo or call a friend or a cab to get them home? They ( The celebrities ) are afraid of leaving their $100,000 cars in a parking lot all night and so what if it gets vandalized, their insurance will pay for it. It would be ALOT cheaper than to get behind the wheel if you are drunk and possibly kill someone or yourself.
So YES I think Heather was tipped off, and I pray and hpe she gets help for whatever she is going through mentally and or physically and YES probably the people that tip of the papps get a reward or something, and YES she should get punished according to the law, but as we all know in California, people can get away with murder, literally !!! So I guess we will just have to wait and see how much SHE will get fined and serve any jail time, but I thik this might be her first DUI and traffic violation so yes he might get off a bit easy but the others, who have had multiple traffic violations and DUI's, who served 15 minutes to only 3 months out of the 9 months they were originally supposed to serve in jail, those people DID get prefferential treatment and don;t tell me it was because they had good lawyers. As we all know any lawyer can get you off a murder charge or a child molestation charge even though the evidence is staring you right in the face.
