Spotted: Kelly Rutherford's Divorce Attorney

The woman who plays serial divorceé Lily van der Woodsen on "Gossip Girl" is imitating her character -- she's filed for divorce. Oh, and she's pregnant.

TMZ obtained legal papers filed December 30 in L.A. County Superior Court. Kelly Rutherford is asking a judge to end her marriage of two years to Daniel Giersch, citing "irreconcilable differences." In addition to a child on the way, they have a two-year-old son, Hermés Gustaf Daniel Giersch.

It's Kelly's second marriage, which gives you an idea why she was cast.

17. While Hermes is a Greek god, Hermès, the french spelling containing the accent aigu mark, refers to the French Design House that makes leather goods and silk scarves etc. The kid was definitely named after a handbag.

18. There's nothing gross about breasfeeding a 2 year old. It's the american mentality that makes it so taboo. It's a natural and healthy way to nurish your child. European and asian cultures embrace the idea of nurishing your child through breast milk as long as you see fit. Having said that... it isn't a good idea to breast feed your child if you're pregnant. It's not healthy for your developing baby. Also, good job TMZ! XOXO, very clever!

20. She was on the cover of INSTYLE weddings a few years back. Her husband hurt himself or got very sick and she divorced him while she was on the cover! Now she's pregnant and filing for divorce. Wasn't she on Melrose Place years ago? Sounds like her life is one big Melrose Place mess.

21. I dated Kelly's first husband a) before he met her, and b) after she left him. Carlos was a great humam being with a terrible genetic heart defect--he has since passed away. He loved her so much, and was so sad and angry when he left her. All around, a bad situation.

23. Oh my gosh! I didn't know her first husband died. I read Kelly left him as soon as he was diagnosed. I saw an article years ago titled "CURSE OF THE INSTYLE WEDDING MAGAZINE COVER!:. Almost every bride on the cover of that magazine was divorced within 2 years. I cannot remember all of them but Kelly Rutherford was one, so was Jessica Simpson, Shannon Elizabeth and Andie MacDowell.

24. #20- for real? I didn't see ANYTHING on the Internet that said her first husband died. I know he said he almost died in the shower and she left him a few weeks after that because she just didn't want to take care of him. When did he supposedly die?

25. $18- It is DISGUSTING to breastfeed after age 1. 20/20 had a story last night (1/2/09) about disturbed mothers breast feeding after this age and all the way up to age 9! I think these sicko mothers just liked their breasts sucked on for sexual excitement that they aren't getting from their husbands. At age 6 months, a baby should be on solid foods for nutrition. I am sick and tired of crazy women thinking it is normal to breast feed after age 2 or even put pacifiers in a kid's mouth after age 1. I saw a 4 year old with one in his mouth the other day. Grow a brain!

26. I meant to write- it is NOT normal to breast feed after the first year. These women claim- "oh it's the best thing for baby." Who says? These women need to admit that they like the sucking sensation and their husband's won't touch them because they are fat and insane. I hate women who do this in public too! Do you want to watch me give my husband a BJ in public? That is sucking on a part of the body as well so I can claim this is perrfectly normal as well.

28. Carlos, Kelly's first husband, died 2 years after he initially collapsed in the shower, of the same ailment. Kelly left him while he was recovering in the hospital from the first attack. She didn't even tell him, his doorman did, when he was allowed to go home for a few days. She is a moron an idiot and an incredibly shallow woman, she didn't have the fortitude to stand by her man in rough times. Carlos was the most amazing person, and no one would ever tell you different. To meet him was to like him, he even through a party for all his nurses and doctors after the 1 year anniversary of his "death," since he was clinically dead for 10 minutes after his first collapse. I just wish he had a stronger woman by his side although he did have plenty of friends and family with him throughout. He was cool.

The American Academy of Pediatrics (AAP) recommends exclusive breastfeeding for the first six months of the infant's life and AT LEAST one year of breastfeeding in total."

30. The average age in the world to step breastfeeding is somewhere between 2.5 - 7 years old. Worldwide. It's North America that has this "dirty" connotation to breast feeding past 6 months.
