Brown Wants Misdemeanor Plea, No Jail Time

Chris Brown ExclusiveSources tell TMZ Chris Brown would cop a plea, but only to a misdemeanor and with no jail time. After we broke the story yesterday AM it has triggered a passionate public reaction.

We're told Brown's people have consulted with outside legal eagles -- including law school professors -- who have said Rihanna's own aggressiveness takes it out of the felony category. Sources say Rihanna was the first one to strike -- slapping and striking Brown "numerous times" while he was drivΩing, after seeing the text message from another woman. And Rihanna was fighting Brown as he punched and hurt her. We're told much of this is reflected in the official police report based on what Rihanna told cops. As a result, they say, this is not a case that demands a felony plea.

On the other side, there are plenty of cases in which the woman engages the man in a fight but the jury convicts the male because it was an unfair fight and the man could have walked away. The photographs of Rihanna -- the most graphic of which have not been seen by the public -- demonstrate Brown's superior strength. Add to that the fact that Brown had no significant injuries and it presents problems for him.

Perhaps worse for Brown, sources tell TMZ Rihanna told cops he had beaten her before and the violence had been escalating.

And there's this. According to the detective's note filed with the search warrant papers, Brown sent a text message to Rihanna's assistant in which he apologized for what he had done to Rihanna and said he was getting help. That would be admissible in court and extremely damaging -- as a legal admission.

they are both in the wrong, what was she thinking hitting him no less while he was driving, if she knew he had a temper it's even worse, they just should have broken up if she had enough of him that she needed to hit him, can't see this relationship working out at all if it's this toxic, they both need help, but he could have pulled over and got out of the car himself, it doesn't excuse what he did, i would be too scared myself to hit any man in case i got it back myself, why bother hitting him just should have broken it off and be done with it then and there no more drama's, hitting doesn't accomplish anything... they are both very immature and stupid from the sounds of it.

Seriously...stop with the whole bringing-up-race and then playing the race card thing. Soooo tired. Your boy and his lady are sitting at the head table in the White House and they're there because enough people of all ages, genders and ethnicities looked past their race and voted for whom they thought was the best candidate. The whole race-card argument is officially over now, in case you didn't get the memo.

You making assumptions about the ethnicity of posters on this board and then saying that their ethnicity "explains (their) biased feelings on the situation..." (and what does that even mean, btw?) does a disservice to the President, everyone who voted for and supported him and his vision, and Black America in general.

And TMZ, your comment that "Chris Brown sent a text message apologizing for what he did" is a bit misleading. I think it would be more accurate to state that "a text message apology was sent from Chris Brown's phone," right? Because unless there's a witness to corroborate the fact that it was Chris himself who typed and sent the text, we don't actually know that he's the one who did that, right? I would imagine that would be the argument his defense attorneys will make.

Oh sheesh,

There were reports even before pictures and the warrant information were released alleging that Rihanna struck the first blow. This is nothing new. Any information released contrary to what Rihanna has ALLEGED or that suggests she does share responsibility in this fiasco is against the public mood of hoisting Rihanna as a victim of domestic violence and portraying Chris as a heartless monster. All allegations of what Chris Brown actually said and did was reported by Rihanna and may not be entirely the truth. I'm not convinced yet that he's as horrible as some of you say.

Ok, first of all, all the legal help in the world isn't gonna keep you from being punished for beating the CRAP out of your girlfriend. Second... no District Attorney in their right mind will agree to these terms. Third.... it says in this article that Rihanna was hitting him back, OF COURSE SHE WAS, HE WAS SMASHING HER FACE INTO A WINDOW AND PUNCHING HER IN THE MOUTH, I'd fight back too!!!! Also, if he really was messing around, or attempting to mess around, with a 16 year old girl, then Rihanna had every reason to be pissed, and, her parents have every right to see to it that his face is smeared in mud for messing around with an underage girl... it's called statutory rape. The only bad thing for Rihanna is that she is seeing him again, and there are rumors of pregnancy and marriage, gawd I hope neither are true. Rihanna, take my (and everyone else's) advice and dump this loser. He will never change, he's too young to understand a serious relationship, and violence only gets worse. If Brown is claiming that Rihanna hit him first and he hit her back in self-defense to avoid having an accident, for example, isn't he only allowed to used equal force to defend himself? Where is Harvey, the lawyer, to clarify this? Clearly, he beat her with unnecessary force. He walked away without a scratch. Give me a break. He deserves to be charged with a felony.

If Rihanna does not testify, I hope at least she is getting paid big money for her silence and that she walks away from him once its over. I am wondering why JZ and P.Diddy are so involved and vested in protecting Brown.

Paris was jailed for violation of her probation. The violation was driving without a license. She was charged with DUI but allowed to plea to reckless driving. Paris has never been convicted of DUI.

To all who do not like her: Paris did more of her sentence than the average first offender convicted of a sex crime.
