Files for Divorce

We've learned Mel Gibson's wife Robyn has just filed legal papers to divorce Mel Gibson, her husband of 28 years, citing "irreconcilable differences." Pretty ironic -- Robyn signed the papers the day before Good Friday.

Sources tell us there is no prenuptial agreement -- they were married in 1980, before Mel Gibson amassed a fortune estimated at $900 million back in 2006. Under the laws of California, community property -- which includes earnings -- is divided 50/50.

The Gibsons have 7 children, but only one -- Tom, who turns 10 tomorrow -- is a minor. In Robyn's legal papers, filed this morning in L.A. County Superior Court, she seeks joint physical and legal custody of Tom.

Robyn is also asking for spousal support and attorneys fees.

Robyn lists the date of separation as "to be determined." This is important, because earnings generally cease to be community property when the couple separates. There could be a skirmish over this. We're told the couple grew increasingly apart over the last few years, especially since Mel's drunk driving arrest in 2006.

There have been reports that Mel has been involved with another woman, which the actor denies, but we're told the reasons for the divorce go beyond any third party.

Launch PhotosIf there is a fight, Robyn is in good hands -- she's repped by disso-queen Laura Wasser, who has handled divorces for the likes of Angelina Jolie, Britney Spears and Stevie Wonder.

UPDATE: Robyn and Mel Gibson just issued a statement: "Throughout our marriage and separation we have always strived to maintain the privacy and integrity of our family and will continue to do so."

Sources tell TMZ the couple has been separated for more than 2 1/2 years. We'll see if Robyn agrees. Again, the separation date is important in dividing assets.

I am confused by the raw rage expressed in many of these comments. Maybe I have missed a lot, but what's up with that??? This a real family who is going through the nightmare that is divorce. You know I hear a lot in the media about tolerance as it relates to so many cultures/lifestyles/groups, but not so much for Christians. How many of you actually know this man? Much less his family? It does seem that he has made many mistakes, I acknowledge that, but how many of you have not done stupid, hurtful things to those you love? That's human and we as Christians are as human as the rest . . so thank God for mercy and grace. We all need it!! Does this make me a religous zealot? By the way, the Word of God is not prehistoric, it is timeless, relevant and full of life's answers. when read with a prayerful perspective and an open heart.

Satish???? You are obviously very young. Rich, slim 50 year olds are finding love all the time! Heck, my mom wasn't rich or slim and she divorced at 50 and remarried at 52. She is now 64 and very happy. Never, never stay in a relationship our of thinking your life will be over. Dump the dead weight and regain your life!

By American standards this is a long-lived marriage and this wife and mother of seven children has been extremely dignified, tolerant, and supportive of his work and extracurricular activities during the years of their marriage. He's been a great actor, but she now deserves her freedom as a woman (with only one child remaining at home), half of the monies acquired during the marriage and, yes, half if not all of the divorce, et al. costs. Hollywood has seen no wife of an actor-director who is more dignified than Mel Gibson's wife.

Lana sounds a little bitter, perhaps she is a scorned woman and now has a bad taste. Lana, I think its a little to late for an annulment, after all its been 28 years. You sound crazy with the comment you made, If I did't know any better I would think you were the other woman seeking revenage. It's life people grow apart or fall out of love....we don't know what happened behind closed doors. To sit behind a computer and judge people is crazy we don't know them from Adam. I am sure your life is not perfect.

Opinions aside on the Catholic thing - the rule is - The church sees you as married ONCE. The church discourages divorce, but to be divorced is not to be a bad Catholic. Unless there is an annulment which, frankly the church should see this as a valid marriage (welcomed children, 28 years, long term, etc) - neither party can be remarried in the church.... and are not to be remarried outside the church.
so that's the rule of thumb there.
That said - Gibson, being religiously tightly wound - involved in outlier groups within the Church (I think he's rumored to be Opus Dei) - you had to expect that something was bound to snap. You make too many expectations on yourself, your marriage, and your family - you set yourself up to fail. Simple as that.
The wife was with him when he had no fortune or fame, and was a partner in the marriage and the business of his career - it is only reasonable that she should get a fair and equal portion for raising what - 10 children, providing a stable home life - etc. He was the wage earner, they lived low profile - she deserves a quiet and fair settlement and it wont hurt Mel to part with half his worth. I think I could live on 450M.
And if anyone is offended by the divorce settlement - understand that there are 10 kids who will inherit most of it from both parents when they pass away.

# 4, You have to be a man. It was his fault, he should have been home helping raise his children sometimes, money isn't as important, when youi find yourself stuck at home with a host of children. He always seemed arrogant, anyway. There's many reasons for divorce. I was married 23 years and guess what? I found out my husband had a male lover, we had 5 children(one deceased from Leukemia), so women when your husband is gone from daylight till dark and he suddenly wants a divorce, follow him and you'll find out why he wants a divorce and it isn't always another woman!

It's a shame to see this happen, but Susan you are soooo right....people change and people grow up and people grow apart.
I am not condoning any of the cheating or anything, but people do change and sometimes the other person doesn't grow with them...like a tree branch...up and apart. I have been married 29 years so I DO know this from experience!

I'm afraid this is not just a case of a couple growing apart over the years. Mel himself has said that he has been drinking and doing other things that make it impossible for a marriage to last, and this has been over many years. I think that his wife has put up with a lot during their marriage and perhaps him acting like he is really out of control lately made it plain to her that the marriage was over. Since they seem to be religious perhaps staying together for the kids didn't seem as important now that the kids are older.

Mel said he has had trouble with drinking for a long time and that will make people do a lot of things that they might not do if they were sober. I hope she does get a lot of money for raising his 7 kids and staying married for as long as she did.
