Jackson's Mom Keeps Option Open to Contest Will

Lawyers for Michael Jackson's mother Katherine filed legal papers setting the stage for a fight over the singer's estate.

Katherine's lawyers are not willing to accept that the will presented by Michael's lawyer, John Branca, is valid. In the papers, Katherine's lawyer writes about the "purported will" Branca filed.

Katherine's lawyers note that the 2002 will has a "no contest" clause, meaning anyone who mounts a legal fight over the will gets nothing.

Katherine's lawyers want a judge to decide if that clause would apply if she fights the appointment of the executors under the will.

Katherine's lawyers are hedging their bets, saying they are "continuing to collect and review relevant information."

#89, I don't think anyone thought she had to support his kids with her portion but were referring to the other grandchildren she has in the house from her other kids. God only knows why she has to raise them.

The elder Jackson's are going to totally f$%K this one up and end up getting nothing. A no contest clause leaving no options open to contest anything written in the will is just that. If the executors are named in the will, which they are, she would be breaking the terms of the will by challenging it. As soon anyone representing her challenge the will in court, the children's counsel automatically have a case to take 80% of the estate for MJs three children. The executors would then have more money to manage for a longer period of time thus making many additional millions for themselves. Could they, the lawyers, be giving Katherine this bad advice in the hopes of getting her and Joseph out of the picture?

The will stipulated that when Katherine passed, that her 40% would go to his children.. giving them 80%. 20% still to charities. Katherine can not stipulate that after her death, her share goes to anyone. She *could* while alive chose to share the money with whom she wanted, depending on how the distribution is set up. There might be a clause that she has a set amount given either monthly, quarterly or annually.. or something like that.

Since it appears Michael made it clear (by exclusion) that none of his siblings or other parent was to get anything, he, I am sure, knew that Katherine would share her portion with them while alive. Remember too, that to the best of my knowledge, the "Encino compound" is in Michael's name (I saw that on a 2007 asset report of MJ's assets).

I am starting to think, thinking back to the judge who made the temporary decisions in the past few weeks about the estate and the children's custody, that judge said it was a valid will. If that holds true, I don't think Katherine (or Londell) can change the executor. They are treading on dangerous grounds by trying to contest it.

Since the executors will have to keep records and remain accountable to the courts, in a fiduciary capacity, I honestly can not see them being removed by the court. I saw that Branca brought in a forensic accountant --meaning they are digging to find where all the money has gone.

...and whatchya wanna bet maybe the Jacksons are wanting to hide how much he actually supported them? (just a guess... )

That's good. She needs to cover everything. If everyone around Michael Jackson was an enabler to his drug problem. They enabled him to leave a friend as the executrix of the will. Which I myself as a mother wouldn't trust anyway. This was Katherines son. Nobody has more rights than the mother when the son was not married. Also remember that the person handling the 50 concert deal in london is also the person that hired Dr. Murray. Is this by any chance the same friend named in the will as the executrix? If so it smells awfully foul to me.

I don't think the executors can draw any money from the estate other than the fee that will be set by the judge. I would like to give Katherine the benefit of the doubt and not say that she is greedy and that is why she is looking into the "no contest" clause. I think that the other members of the family are pushing her to test the water and see if it can be broken. I am sure that Michael knew how it was going to go and that is why the clause is in the will in the first place....interesting...............

another thing~Latoya made the statement in her PAID interview that she knew stuff about Debbie and she doesn't want to mes with the Jacksons or she will tell it,,UHHHHthe way I see it IF Latoya had such damning evidence against Debbie there would have never been negotations???LOL

Cali MJ fan- Thanks I did not know what the will said- I would have hoped he would want her 40% to go to his children making them get 80% if his mom passed away- He loved his children and they loved him-Sad they don't have their dad- very sad!!!!
