James Jay Lee -- the gunman currently holed up with hostages at Discovery Channel headquarters -- was ordered to a mental institution after a 2008 environmental protest ... TMZ has learned.
Lee was arrested for disorderly conduct during his protest outside Discovery headquarters in Maryland two years ago -- after allegedly trying to draw a crowd by throwing money all over the sidewalk.
Lee was found guilty of disorderly conduct -- and the court ordered him to serve time in a mental institution.
But according to sources, Lee never stepped inside a hospital -- we're told he was released after 14 days in a local jail ... and got off with 2 years supervised probation.

He only spent 14 days in jail for his last offense. Look what happened. They should have followed up on his status and made sure he went to a mental facility. My heart goes out to all those involved and hope this turns out better than expected.

I will never understand why authorities don't take mental illness more seriously. If this man is truly mentally ill and depending on what that mental illness he has the potential to be very violent. He can do great harm to others as well as himself. Paranoid schizophrenics who do not take meds can be killers one minute and totally docile the next. This man has no business walking the streets if he is that ill.

You know, I don't understand how the sytem does not follow up on these matters and just let's people go walking free.. didn't something similar happen with the last guy who went on a rampage at a school campues a couple of years ago? he also had records of being mentally unstabled?
