Katherine Jackson Sues AEG Over Michael's Death

9/16/2010 10:17 AM PDT BY TMZ STAFF

Kathrine Jackson believes the death of her son Michael Jackson could have been prevented ... if it wasn't for the "negligent" actions of the doctor who was hired to keep him healthy.

091510_katherine_video
During a recent interview, Katherine was asked if MJ's death was avoidable, to which she responded, "It could have been prevented because he had hired a doctor to watch over him. The doctor was negligent."

As we previously reported, Katherine Jackson and Michael Jackson's children are suing AEG Live -- claiming the company breached its agreement to provide physical care for Michael Jackson -- and that AEG was negligent in their hiring of Dr. Conrad Murray as MJ's physician.

In the suit, Katherine claims AEG's contract with Michael "created a legal duty for AEG to act reasonably toward the physical well-being of Michael Jackson."

In the document, Katherine also blames AEG for hiring Dr. Murray without  a proper background check -- claiming, "AEG did not provide a doctor who was truly looking out for Jackson's well-being and did not provide equipment."

The suit also alleges AEG caused emotional distress to Michael's son Prince because he witnessed Michael suffering and dying, and "he was put in a position as bystander to these tragic events."

Kenny Ortega, who produced the planned London concerts for Michael, is also named as a defendant.

The attorney who filed the suit, Brian J. Panish, released a statement saying, "The purpose of this lawsuit is to prove to the world the truth about what happened to Michael Jackson, once and for all."

Heidi & Spencer -- Kiss & Make-Up

This photo pretty much proves Heidi Montag and Spencer Pratt aren't getting divorced ... and may also make you lose your breakfast.

The Situation -- He Shore Found a Nice Apartment

When The Situation decided to go apartment hunting in Los Angeles, he picked out a place with the most guido-sounding name he could find -- The Palazzo. Ay-oh!

0913_situation_launch
But in all seriousness ... The Palazzo is a giant, swanky apartment community the size of a small city that happens to be located right near the CBS lot where "Dancing with the Stars" shoots. We're told he had his eyes on a unit that ran more than $5k per month ... but no sweat off his brow --  "DWTS" picks up the tab.

And the best part -- he doesn't have to share a bathroom with Angelina!

Did you see the 'THIS IS IT' Movie/Video? Michael is seen saying... see yo in July and you have 4 years. Was that Michael or LaToya visiting Bubbles in July in Florida... never showed her face... totally covered. Is he dead? Look, in business he was smart. He set his family up. "ONCE AND FOR ALL" . . . . how much is enough? R.

M'Haliah,I'm not arguing that Murray incompetently handled the situation, but the suit contends AEG was negligent in due diligence in hiring him. In other words, what would a proper background check have revealed that would have indicated Murray was incompetent enough to have let this happened? (I don't know the answer, since I haven't followed the case closely) If his background was unremarkable, it's going to be hard for Ms. Jackson to prove her case. Also, who did the actual hiring? AEG or Jackson himself? I get the feeling Michael made a lot of his own decisions no matter what anyone else said.

If I was totally cynical I would suggest that, since Murray is facing bankruptcy, the Jackson parents may be trying to find another "deep pocket".

BTW, I like the term "Hateration"....may end up in our lexicon!

I have to agree with every thing that Mi'Haliah has to say. M.J. Didn't do any thing wrong or caused his death and if any one say's any different, then you all should be ashamed of yourself's. M.J was a very thoughtful, caring person, so he had some problems in life but who don't? How can any of you folks judge M.J like that without looking into your own back yards when it comes to who did what? No body is perfect and so M.J wasn't a 100% perfect even tho he tried to. At least he cared and gave his all, matter of fact he gave more to charity to help those who's in need the most. How much have any of you folks gave to charity let alone supported when in need? M.J was not and never was a child molester, just was blamed for it because he was considered a easy target and these folks who blamed him were having finacial problems and seen a easy way out and took advantage of poor M.J. I say it all was ignorance and jealousy of what M.J had and what someone else wanted, MONEY!!!!!! All they were was money hungry bastards wanting a free ride and a free meal ticket on M.J.'s expense and look what happened, it distroyed the man's life. All of who wants to talk down on M.J better look in your own back yard before judging him or any one else, other wise it will come back to haunt you let alone bite you in the end.

Whatever you want it to be

The one thing I despised about Jackson was his constantly being dressed up like an admiral or something in high command! Am I sorry he died? Sure. I wish death on nobody. But, when every network covered his 12 hour funeral, then it was way too much!

We lost a great entertainer when we lost Michael Jackson. But I think at some point his family need to also blame him for what he did and brought upon himself. They keep denying the fact that he was hooked on medications and pain pills and after a long time of doing this it took it's toll on him sad to say. Also it seems like he was the kind of person that wanted what he wanted and you had better not say no to him and I feel the doctor did what Michael told him to do because he could and perhaps he didn't listen to the doctor about it being dangerous to take this medicine that ended up killing him.He is sadly missed by all that loved him but I think it need to come to a stop with the finger pointing and everyone wanting to file lawsuits on this person or that person it's become a money thing now I feel. Allow him to rest in peace and stop all the bickering because it's not going to change anything and it's surely not going to bring him back.

Jackson fan

I do not agree that the mother Katherine Jackson has the right to sue. Did she ever stop to think that Michael hired his own doctor and this is what he wanted. As long as he was okay with it who are we to complain or try to sue someone for his death.I am still a very big fan and sadden by his death but when it is our time no man on this earth can stop it. If she truly believes in Jehovah she will know that no matter what we do here we have to leave just like we came in. She can not also believe that she can sue because his son just so happen saw his father die, WTH, what about all those other children who has had to witness their parents dying some of them in their arms. It is not the companies fault, and she sounds alot like Joe by becoming sue happy, why wait a year after he is dead to pursue this, if she felt that way in the beginning she should have done it then. Let's get real he is gone never to return, how can anyone profit from someone's death especially when you were not apart of their success. Time to move on let the children grow up and be happy.

will all the money in the world being sued for bring michael jackson back? no. let it rest jackson family. he made his choices, he was an adult, and had the power to say no if he didnt like how things were going. bitterness and lawsuits never solved nothing.

At this point;ONLY MICHAEL AND AEG knows who choose Dr. Murray as his doctor. But Michael also put his life in Murray's hands to take care of him properly. If Dr.Murray did not have the proper equipment to care for Michael [THAT IS ON Dr.Murray's hands and should have been upfront with Michael as a medical professional and made a smart decision and not given Michael an overdose of PROFOFOL.No matter how you look at it;Dr Murray was resposible for keeping Michael alive, and he did nor do that....NO MATTER WHAT THE OUTCOME OF THE JURY'S DECISION-Dr. Murray will have Michaels blood on his hands and 90 percent of this world will never forgive this doctor for taking Michael from us!!!!!!!!!!!!!!!!!!

Michael Jackson was the only person respondsible for Michael Jackson. He was 50 yrs. old and nobody should of had the respondsibility of taking care of him. He was a freak and a child molester and thats about it. Yeah he gave to charities to cover his darker side. His parents were part of his peter pan syndrome but they never took any blame now did they. All they wanted was his money. Those kids should have been given to their own mothers or Janet or LaToya not the money hungry grandma or if you want to call Joe this grandpa.
