TMZ has learned ... Lindsay Lohan's lawyer, Shawn Chapman Holley, has just filed legal papers appealing Judge Elden Fox's ruling that Lindsay should be held without bail.

Lindsay Lohan Jail Appeal
Holley claims the judge must grant bail in such a case -- and is asking Judge Patricia Schnegg, Assistant Supervising Judge for the L.A. County Criminal Courts, to vacate Fox's ruling.

Unless the ruling is overturned, Lindsay could spend the next month in jail ... waiting for the next hearing.

It is astonishing how desensitized the public has become over police state micro-controlling tactics. Regardless of her innocence or guilt, she was literally targeted for prosecution, under the duress of never-ending "looking over her shoulder" by the government. The "touch" where government as aligned itself with psychologists who have their hands in the public's pocket versus the duress of going to jail and extreme sentences that the public can't afford, over and over again, and again, and again. This is also seen in domestic violence cases. The government is literally bleeding the public dry of their private funds to maintain their status quo. And for what? The ego of the Court? The comments here show me that everyone has become so emotionally violent because our laws force us to be violent in our concept of "justice". Someday, civil war will bring back normalcy versus the government continually attack their own people. She has been publicly humiliated. She should be released immediately. This is my opinion.

Here is reality in a nutshell. American's for the most part, and I am one, do not want to take responsibility for what they do. So scientist and doctor's play on that idea and invent clever ways of enabling people to believe they are not responsible, when in fact they are. A perfect example of this is the notion that alcohol abuse or drug abuse is a disease. Anyone who takes a brief moment to go back in time and study will find that alcoholism and drug addiction were never considered a disease until 1982-1986. Why? Allow me to answer. During that period insurance companies did not want to cover helping the addicted, they did not see it fitting as a medical condition requiring treatment.(and truth be known, it doesn't, there are thousands if not millions of people who are not "recovering" but have recovered) So what you are seeing now is the repercussion of the medical communities ridiculous idea of labeling addiction a disease. Sure it is a dis-ease to come off drugs, but a disease-no way. Who ever heard of buying a six pack of measles? Lindsay Lohan is a young actress by profession who in no way has any disease at all in regards to alcohol or drugs. She is not recovering from anything. The original "crime", if you even want to call it that, for DUI occured in 2007. All matters pertaining to that "crime" should well be over. But they are not because probation is a set-up from the get go for what many would call a "disease". IF IN FACT SHE HAS A DISEASE, WHY IS SHE IN JAIL?

Lohan likes the party scene. The only thing that has kept Lohan and Hilton in the spotlight is the Paps. When the so called money shots are no longer worth money the paps will move on.

If it is everybody's choice, then why have the laws in the first place. I guess all the lawmakers are wrong. Yeah, she hasn't killed anybody, but she came damn close when chasing that car on the PCH. Precedent has been set with her. The judge was not in a personality conflict, the defendant has priors and behaviour which has not conformed with the law. I'll go into an office and wave a gun around...don't think the police would take me down? But I didn't kill anybody. Stop trying to rationalize this. She has violated parole and she is a flight risk...go to jail

Mark my words Supervising Judge Schnegg will vacate Judge Fox's ruling and set bail. You don't refuse to set bail for misdomeaner alcohol offender who has failed a drug test and awaiting their VOP hearing. It's stupid and petty, and Judge Schnegg won't stand for it! :)

If Lindsay doesn't win the appeal then on October 22nd she should just refuse probation and they will let her go as soon as possible because of overcrowding.

After throwing her in jail without bail this Judge actually expects her to meet with her psychiatrist and addiction specialist just because she is in solitary confinement.
It is unbelievable.

Interestingly enough, all of this in a state that made marijuana legal, virtually. LOL.

My friend a defense attorney told me that his client was out on bail on a DUI in NY and got arrested for something nonviolent and nonalcohol related and MERELY getting arrested got his probation revoked and he had to SERVE 6 months.

Lindsay is being subject to the REAL JUSTICE system, as she should.


Dry out LL and kick those people out of your life. EVERYONE now thinks you are a liar. Take some time off.

While I think working will keep her from idle hands and minimize the partying,hopefully the Inferno people cannot get her insured. Terrible career move.

Chapman Holley is 100% right on this move. The judge does not have the right to set put her in jail without setting bail. She did violate probation but a seperate hearing needs to take place and if found guilty she will be sentenced at that point. Lindsey Lohan needs to go back to jail but the judge also needs to follow the law. THE JUDGE IS 100% WRONG FOR NOT SETTING BAIL AND HOLLEY WILL WIN THE APPEAL GUARANTEED. SHE WILL BE OUT ON MONDAY, MARK MY WORDS. JUDGES ARE NOT ABOVE THE LAW JUST AS LOHAN IS NOT.

@182 Number one, yes most of the judges are incorrect.

Number two, she is not on parole, she is on probation.

Number three, what she could do makes no difference to me and it should not to anyone as well, because we are all capable of many things but whether or not we commit them is the difference.

Number four, how many people actually have a designated driver after a night on the town? And if not, why is there such ambiguity between the public consumption of alcohol and driving. Afterall, if politicians were really so concerned about drinking and driving-why not outlaw public consumption all together?

Number five, she is not a flight risk or she would not have appeared in court today.

Number six, wake up America, look at these clowns running our country. Telling you they know what is in your best interest.

It is high time someone drag these politicians, and judges out by their ear and throw them down the steps upon which they walked up.

She defended OJ.

My friend the attorney will only defend DUI cases once. If they reoffend he DROPS them and he reads them the RIOT act when he takes their case...and he's a great attorney.

Hey there katie 10...this is the "dork"replying. You don't think that having prior convictions means anything do you. Yeah maybe if she was just a regular drunk and coke head she may not have the means to leave...but this sack of **** certainly does and has family that would be willing to help her out. With her type of record she is not legally entitled to bail. Get your head out your (and team Lohan's) ass. The LA county court is sick of her making a mockery of the justice system just as they would be of anyone else in her shoes. She goes to jail. You add a misdemeanour on top of other criminal offences and she is not entitled to jail...considering that she isn't even finished serving her sentences for priors. You are a ****ing joke
