Victim's Mom Sues in Deadly Desert Race Disaster

12/29/2010 9:30 PM PST BY TMZ STAFF

The mother of a man killed when an off-road driver plowed into a crowd of spectators at the California 200 desert race is suing the man behind the wheel -- claiming the tragedy could have been avoided with proper safety measures.

Andrew Therrien

In a lawsuit filed today in L.A. County Superior Court, Doris Levinson claims her son Andrew Therrien was watching the race with his 3-year-old daughter back in August when driver Brett Sloppy lost control of his 5,000 pound truck and barreled towards the crowd.

Levinson claims ... as the truck approached Andrew and his daughter, Andrew managed to shove the little girl out of harms way -- but he wasn't so lucky ... and died from the injuries he sustained from impact. Seven other people also died in the crash.

Levinson claims Sloppy and the company behind the race -- MDR Productions -- were negligent, careless and reckless ... because they failed to take proper safety precautions.

Levinson claims Andrew's daughter sustained "severe emotional distress and mental suffering" due to the incident.

Levinson is suing on behalf of her granddaughter and her son's estate -- she's asking for unspecified damages.

So before y'all want to run your ****ing mouths about something you know nothing of get you **** straight, I don't care if your white black orange or purple this sprort is loved by all there needs to be stricter rules but it is not Andrew, his daughter or Dori's fault for that and it sure as isn't cause for anyone to talk **** about a man who is not even here. What do you want to do sue his ashes call them stupid??? You are all pieces of **** for talking about a hero negativly who isn't even here to stand up for himself and I hope karma bites you in the asses for it ****ers.

No one's saying Andrew's a bad person.
He was however an adult and able to make his own decisions. As a fan he obviously knew what he was getting into. Being a spectator at these events isn't the smartest thing in the world.
That being said, the promoters should think about extending how far back the audience should be because this isn't the first time something like this has happened.

So Andrew's mom is suing MDR because Andrew made a bad decision?

Are we responsible for our own safety, or do we give that important right to somebody else?

Very sad that little girl is going to grow up without her daddy. Parents, make smart decisions, the lives you affect are more than just your own.

First of all, alot of you need to learn how to spell and write. You sound like a bunch of idiots. Have you heard of proof reading?
Second of all, all the people standing right on the track made a bad decision that night. Luckily there were only 19 people total that were affected physically. There could and probably should have been more with the size of that crowd.
Lastly, I am sure Andrew was a great guy/friend/son/father, but lets face the facts. Like many times mentioned before, he chose to spectate the race from that particular location, from that particular distance away from the course and unfortunatly an accident occured. The bottom line is, stand up for your own mistakes, don't point the finger for your dumb ass deceision. It was public land, and he had avery right to spectate from where he was, but a little common sense would tell you to chose another location, even if it was just across the track.

I remember this, and the driver felt awful, there was stuff coming out for awhile about how the driver was incredibly depressed. The PROMOTER/ORGANIZER of the race should be liable for all the deaths/injuries that occurred there, they should have some barriers, or at the very least place marks for the crowd to stand behind at at least 100 ft, while I agree with the fact that he should not have had his 3 year old there, this guy might have been going to these type of races for years and never thought this would happen, plus the truck slides way off. I think the promoter's should be responsible and pay out some cash, at least for medical bills/burial expenses.
