Lindsay Lohan Wants Plea Deal

2/10/2011 9:00 AM PST BY TMZ STAFF

Lindsay Lohan insists she's innocent but still desperately wants to plea bargain her felony grand theft case because she's terrified of being locked up ... sources connected with the case tell TMZ.

Lindsay Lohan Court

Judge Keith Schwartz set a court hearing for February 23, so the lawyers can talk plea bargain.  We've learned Lindsay is willing to plead guilty to make the case go away, provided she doesn't get any jail or prison time.

Sources say the prosecutor wants jail time so there's an impasse.

But there's another way Lindsay can make this case go away.  When there is only one charge on the table -- as there is here -- the defendant can essentially cut a deal with the judge, cutting the D.A. out of the picture.  If Shawn Chapman Holley offers to plead guilty to felony grand theft, with the judge's assurance he won't put her behind bars, the case could go away.

And, it's common in cases like this for the judge to reduce the offense to a misdemeanor if Lindsay stays out of trouble for 12 months.

Danette Meyers is just trying to make a name for herself. Like she's going to be guaranteed and election win if she puts pretty blonde starlette behind bars. If she wants to win that election, she should be doing someting about that nappy hair of hers first! It's just so damn obvious she has it out for LL that I personally would NEVER vote for her!

How about this judge: Quit giving this bitch probation because she's always violating it anyways. Its time to treat her like a non-celeb and throw her butt in jail where she belongs. At the very least she should be forced to serve the entire 160... or 180 days (whichever it is) for violating her probation from a previous crime.

If she continues to not do longer than a week jail times for all the problems and law breaking she's done, I'm going to be a criminal too!

For God's sake put this stupid, selfish, careless, disrespectful, untalented little twit in jail!!!! If she walks I think that EVERY individual currently in jail or state prison for the same charge (or collective charges)and those who served jail time, should start a lawsuit for discrimination, unfair treatment, and/or bias to a celebrity (and I can barely use that term in her case). The only thing this brat has added to society in the past 3 years is laughter and illegal acts! She is just disgusting.

Love TMZ just sick of seeing Lindseys face everyday. She is far from a great actress, does nothing for anyone besides herself, thinks the laws of the land don't apply. Maybe if you stopped showing her so much attention she would go away. the sooner the better.

you see, there is a huge problem with lindsay taking a plea deal that involves probation. 1. even a no contest plea with no jail time and only probation is a violation of her dui probation. 2. chick cant stay out of trouble with the law for 30 days as it is so she will just do something stupid, "slip up" and get hammered or high, or just do some dumb sh*t that ends her up back in court facing a pissed off judge in a felony case.

lindsay needs to go to trial, go on the offensive big time, create reasonable doubt, hang the jury, do her jail time in the dui case (it isnt that bad bitch, just sleep for a few days until they toss you out) and then get the eff out of the US of A. go rent a small apt in some european city and just relax with a couple friends. come back when you are mellow and can stop being an idiot and making completely stupid "mistakes".

Does anyone know the sentence people with records similar to Lohan's have received in the past in L.A. County for felony shoplifting convictions? Is it no jail, 6 months, 1 year, 2 years, or 3 years?

How could a judge possibly consider a no-jail, provided she stays out of trouble, deal with her when she's already on a probation under a threat to go to jail should she get into trouble deal?

And a felony theft charge is certainly 'trouble.' This person is a a sociopath. She evidently feels impervious to the rules of society and has thus far been spared serious punishment. The judge should reject any plea and so should the prosecutor. She should be forced to pay the expense of her defense and serve a couple of years in prison.

Really can't sympathize with her. She's on a fast track to self-destruction and I personally don't care but it seems that she harms others as she continues to make her exit from life.

And she can take Charlie Sheen with her. Huckleberries!!

I cant believe there talking plea deal, When you violate your probation you go to jail, plain and simple as other non celebs do. I wont think much of our judicial system if she gets off without substanshial jail time.

she doesn't have to plead guilty to make the deal and violate her probation. If she pleads NO CONTEST this deal could still be made without violation of probation.
