Lindsay Lohan -- Surveillance Tape Backs Her Story

Lindsay Lohan was in no hurry to leave Kamofie & Company the day she allegedly stole a $2,500 necklace -- in fact, she yakked with the owner for several minutes before leaving the store.

According to sources who have reviewed the tape, Lindsay wore the necklace almost the entire time she was in the store. We're told the surveillance video clearly shows Lindsay trying on the necklace, checking herself out in the mirror, and appearing to ask her friend and the store owner for their opinion (there is no audio on the tape).

We're told Lindsay took off her own necklace to try on the store's necklace.

Lindsay never took the necklace off, according to our sources, and she wore it in plain view for the next 45 minutes while she tried on several rings.

According to our sources, before walking out of the store, Lindsay put her own necklace back on, but it in no way obstructed the store's necklace.

Even better for Lindsay, with the store's necklace in plain view, Lindsay is seen talking to the owner for several minutes before strolling out.

Doesn't sound like the actions of someone that tried to steal a necklace, does it?

Theft

Elements

The actus reus of theft is usually defined as an unauthorized taking, keeping or using of another's property which must be accompanied by a mens rea of dishonesty and/or the intent to permanently deprive the owner or the person with rightful possession of that property or its use.

For example, if X goes to a restaurant and, by mistake, takes Y's scarf instead of her own, she has physically deprived Y of the use of the property (which is the actus reus) but the mistake prevents X from forming the mens rea (i.e., because she believes that she is the owner, she is not dishonest and does not intend to deprive the "owner" of it) so no crime has been committed at this point. But if she realises the mistake when she gets home and could return the scarf to Y, she will steal the scarf if she dishonestly keeps it. Note that there may be civil liability for the torts of trespass to chattels or conversion in either eventuality.

FriendofLindsay ---- Surely you must be talking about someone else that is named Lindsay. Lindsay made a choice 4 years ago to start having troubles in her life. At THAT time she was a rising star. So surely friendoflindsay you are still living in the past.

Lindsay has over the past 4 years shown herself to be a troublemaker. But then all alcoholic's and addicts are troublemakers. It's in their blood so to speak.

The Lindsay of today is a far cry from the Lindsay of yesteryear. But lets look at the claim that Lindsay didn't know when she walked out of that store with the necklace on.

She did what any good criminal would do. She played it perfectly too. She had everyone caught off guard, so simply slipping her other necklaces on and knowingly keeping the store piece right there shows she intended to steal it.

She didn't go blind in that period of time when she was putting her other necklaces back on. She saw the one she was wearing, she knew she didn't buy it, and yet she proceeded to act naturally and walked right out of the store.

So she comitted the perfect crime, except for those darn video camera's watching her every move. She surely had a great career ahead of her 4 years ago. I mean the theft of this piece of jewelry proves she's a good actress.

But she's become a burden to Hollywood now, there are only so many chances they can give someone and I think she has used up her chances. Now she's a has been and she's only 24? She's not in the running for any great movie role. Who would go to the theather to watch her at this point? Knowing what we know about her now, she isn't someone I would waste my hard earned cash on.

Typical shoplifter, she was hoping no one would notice she was still wearing it and even put her own necklaces back on to hide it. Then Patrick distracted the clerk right before Lindsay cruised out of the store with it around her neck. Shoplifters aren't rocket scientists, lol. And to pretend she didn't know she had it on, oh please- lmao! Go to trial Lindsay, try to proclaim your innocence – ha ha ha ha

I'm so glad to see Lindsay's supporters are on here. Will you all bet your own home's that she's innocent and will be proven so if this goes to trial?

Let's not forget she was all ready to make a deal with the prosecutor's until the judge warned that she will be doing jail time. So apparently she was willing to admit stealing it.

If it goes to trial then she gets to spend more time in prison than if she had just taken the plea deal. She's going to jail either way!
