Pete Wentz does NOT want his soon-to-be-ex wife Ashlee Simpson to get primary physical custody of their 2-year-old son Bronx -- as she's requested -- and now he's taking her on in court ... TMZ has learned. 
Wentz just filed legal papers in response to Ashlee's divorce petition ... asking the judge for JOINT physical and legal custody of their son. In her divorce petition, Ashlee checked the box that indicated she wanted primary physical custody.
According to the docs, filed in L.A. County Superior Court and obtained by TMZ, Wentz also wants each party to pay their own legal fees ... even though Ashlee asked the court to make Pete foot the bill for both sides.
And while Ashlee didn't specify the official break-up date in her papers -- Pete says the two called it quits on Feb. 9 ... just days after Pete came home from a wife-less trip to Dallas for the Super Bowl.

These two kids are way too young to be fighting for child custody. It's a shame the people in Hollywood can't be civilized when it comes to parenting.

Why shouldn't he have joint custody? I see lots of pictures of him out with his son where Pete's carrying a bag for the kid and caring for his son, and he just always seems to be a good dad.

There’s a whole lot of money that goes with the kid(s), which is at least partially why everybody fights over who gets custody.
Hollywood’s custodial parents average $25,000 each month for EACH CHILD.
Joint custody until the child begins school...then primary physical custody should be with ONE parent to ensure continuity for the child's education.
A couple of 3rd-tier "entertainers". I feel sorry for their little boy.....
Judging from the TMZ pap shots, he spent just as much time with his son, if not more, than his wife. He SHOULD have joint custody. Why should he and the child suffer because she's a spoiled brat (aka a Simpson daughter).
Good for him. Why shouldn't he get joint legal custody? Unless there are reasons we (the public are not aware of). And they should pay their own legal fees...
