I'm Goin' to Trial!

Lindsay Lohan will NOT take the plea deal the judge is offering in her felony grand theft case ... TMZ has learned.

Sources connected to Lindsay tell TMZ ... Lindsay met with her lawyer, Shawn Holley Tuesday afternoon.  Holley laid out the options but left the decision to Lindsay, who said she's firm about her innocence and wants to push it to the wall at trial.

Lindsay's felony grand theft case will now be assigned to Judge Stephanie Sautner -- who's considered a tough but fair judge -- and the preliminary hearing is set for April 22.

Lindsay faces both jail and prison as the case moves on -- jail,  if Judge Sautner decides Lindsay violated her probation, and prison, if Lindsay is convicted of grand theft.

We have been saying Lindsay was crazy not to accept the plea deal, not because she'd be found guilty of grand theft ... but the way the system is set up, Lindsay could be thrown in jail for the probation violation before her grand theft trial.

Here's the good news for Lindsay.  If she had accepted a plea deal, she would have been placed on 3 years probation -- and Lindsay staying out of trouble for 3 years is highly improbable.

Fact is ... Lindsay has a credible defense in the grand theft case, and if Judge Sautner agrees NOT to rule on the probation violation until a verdict is reached in the grand theft case, Lindsay could get off scot-free.

Wow what a dum dum most likely she knows she can no way in hell complete felony probation so she will fight ti'll the end.

Maybe her and her dad can have a combined trial to save the tax payers of Cali money.

Lohan wants the coverage of a trial so she can model inappropriate court attire every day to make her some cash since the film career is long past dead.

I'm glad she's going to trial. I hope she really gets the book thrown at her this time. No celebrity (quasi-celebrity) justice this time... May her bank account dry-out with lawyer fees.

When I think of "shoplifting" I think of a criminal secretly taking something from a store.

Here, Lindsey knew the store owner, and the store owner knew her. Everyone saw Lindsey leaving the store, openly wearing the supposedly stolen item.

How can that be shoplifting?

If you look at the last 50,000 cases California has prosecuted for shoplifting or theft, I bet there is not a single one that is like this: the alleged thief is known to the store owner, and openly walks out of the store wearing the supposedly stolen item.

And of course there will be a camera inside the courtroom at the trial, so Lindsay can pretend she is acting in a Lifetime movie.

But seriously, I hope she's found guilty, the prosecutor wouldn't have filed charges if she didn't think she could win...but on the other hand, this is California.

If she gets off "Scot-Free" it will be a slap in the face of every law abiding citizen.

I doubt this judge wants to send that message to the young people who watch this despicable woman's every move., which to date has been been one debacle after another.

LOL Only Lil Crackie would thinks she is going to win, the real kick here is the fact that even if the Judge doesn't violate Lindsay right away...Lindsay is still going to be on probation and under her conditions until her trial. Good luck with her not violating!!!

And with the way Trial schedules are she will be waiting at Least a good 8 to 12 months for a trial date. If she violates during that period, that m,eans someone goes to county to await her trial date.

Danette Myers is a genius! Talk about sucking Lindsay in to a no-win jail date... smart lady!
