HUGE Victory In Tattoo Lawsuit

Mike Tyson's tattoo artist couldn't K.O. the "Hangover 2" ... TMZ has learned a judge will NOT stop the movie from being released after the two sides battled over the use of the face tat in the flick.


Warner Bros. released a statement saying, "We are very gratified by the Court’s decision which will allow the highly anticipated film, The Hangover 2, to be released on schedule this week around the world."

The rep continued, "[The tattoo artist's] failed attempt to enjoin H2 in order to try and extract a massive settlement payment from Warner Bros. was highly inappropriate and unwarranted."

As we previously reported, the tattoo artist claims he owns the copyright to Tyson's tat because he created it -- and WB never asked him for permission to use an exact replica of the design on Ed Helms' face in "Hangover 2."

UPDATE: The tattoo artists's attorney tells TMZ they're "disappointed" the motion was denied, but are "pleased by Judge Perry's finding that Mr. Whitmill proved a 'strong likelihood of success' on the merits. We look forward to further vindicating our client's rights at trial .... including a permanent injunction preventing further distribution of the movie."

It amazes me how people think they can sue over nothing. The tattoo isn't real and in all honestly does not look like Mike Tyson's when you compare them. It is much smaller and slightly different here and there. It is also a different color. The tattoo made the movie funny! Stop trying to capitalize on something that anyone could have done. It's not THAT great, really! How many people tattoo their face anyway. It's weird if you ask me! I guess that was the point! Ha!

As an artist myself, it's sad to see so many people believe that the original artist should not be compensated for use of his design. Just because it's a tattoo and not a painting on canvas should not make a difference. It would be like expecting a musical artist to not to be paid if someone wanted to use their song in a movie.

All the bad things on earth like cancer and people are worried about artwork.... how many times have people redrawn mona lisa and other historic memorable artwork. Did God tell you if you draw something no one else can too? The tattoo artist is a prude. I have six tattoo's and my entire side is a one of a kind but would gladly let someone copy them.
