in Airplane Propeller Accident

Lauren Scruggs -- the model who lost a hand and an eyeball when she was struck by an airplane propeller last year -- claims she shot down a $200k settlement offer from the plane's insurance company ... and now she's suing for much, much more.

Scruggs filed legal docs in Dallas, Texas ... claiming the insurance company "verbally offered" to pay her $200k for the Dec. 3, 2011 accident ... and they explained it's the MOST the insurance company can pay out to a "passenger."

But Scruggs is calling BS ... claiming she shouldn't be considered a "passenger" because "she was not in the aircraft or getting in or out of it at the time of the incident."

The 23-year-old model argues she had "completed her exit from the aircraft prior to the time of the incident and was physically located on the tarmac when the incident happened. Until struck by the propeller, she was not in physical contact with the aircraft after her exit."

Scruggs is asking for unspecified damages ... but we're guessing she wants WAY more than $200k.

She should take the offer and be thankful she didn't end up on 1000 Ways to Die. Most people avoid airplanes propellers, even when they're off.

I can't believe she got out of the plane, walked right in to the propeller after they were told to go the back way and now she's suing??? I hope this gets thrown out of court!!! This is the problem with America. People don't responsibility for their own actions!!! They just sue!!

The comments here are amazingly ignorant. Sadly we live in a society that is 'sue happy' so when someone deserves compensation no one pays attention to what really happened. It is THE PILOTS responsibility to have the plane's engine turned off before allowing anyone to get off the plane and a spinning propeller is almost invisible.

Ummm, I realize that what this girl has been through is horrific and her modeling career is most likely over... But, she walked into a propeller, the plane did not crash, nor run into her... I think medical bills should be covered, but beyond that, it was her accident...

She's still a passenger she had just exited the plane, she is the one who walked into the propeller even though people tried to warn her. What a stupid argument. Yes she was hurt but it was an accident and one that she herself has to take some responsibility for.

The insurer of the plane offered the maximum amount for a passenger when they could have easily argued that the pilot was not at fault. I'm sorry her inattention in a dangerous area resulted in the lost of an eye and hand...but she really needs to work with her own insurer regarding her coverage for accidental lost of limbs, rehabilitation etc. and accept that the other insurer is simply "rolling over" due to media coverage.
