-- the stuttering "America's Got Talent" contestant who says he developed his speech impediment from a war injury in Afghanistan -- is firing back at allegations he made up the whole thing ... telling TMZ, his injury and stutter are 100% legit.

Poe's audition aired Monday night -- the singer told the judges about a 2009 incident when he sustained serious injuries during an RPG blast in Afghanistan.

Poe spoke with a pronounced stutter during the audition -- which he claims he developed as a result of his war injuries.



But reports surfaced yesterday that the singing veteran was full of crap -- because no such RPG injuries were ever reported.

Poe tells TMZ, the fact that there is no record of the incident is a common problem -- one that Poe says is endemic when it comes to reporting soldiers' injuries in Afghanistan.

We asked Tim to prove it really happened.  He said he received treatment at a military medical facility in Afghanistan before being transferred to a medical center in Landstuhl, Germany. Tim says he was then transferred to Brooke Army Medical Center in San Antonio.  He did not produce any documents to support his claim.

Tim says he plans to sue his ex-wife and several others for telling the media he was lying.

We asked Tim for ANY hard proof to back his claims -- he gave us nothing, saying he can't release pics or documents for legal reasons. So we gotta ask ...

That photo of Poe looks an awful lot like Army Staff Sgt. Norman Bone in 2006. Oh yeah, because it is. Way to do your homework TMZ.

I served with Soldiers in the MN Guard who served with Poe. Every one of them back up the fact the guy was a slime ball who said anything to get out of duty. He never did a full deployment anywhere.

seriously ?...all these speculations about Tim, if you don't him- then don't judge. I know Tim since he got treated in San Antonio for bad injuries. He was at the same unit with my husband as a wounded warrior. Why would he be assigned there if he's lying ??...and yes he does stutter sometimes..and yes he is/ or was lead singer of a group.

too be honest, his singing was nothing special. playing the vet card was pretty lame in light of the bush-style military medical records and the selective stuttering. it will be a shameful day if he is proven to be a liar. if there is ever a show call "america's got balls," this dude is a shoe-in...

Former marine her; from a family of jar-heads dating to the turn of the century when we came from Ireland. I have personally exposed at least six little P.O.S.' who claim the "Sock" without ever setting foot on the grinder at Diego or in flea town. MINNEAPOLIS (AP) — An "America's Got Talent" contestant scrutinized for claims about being injured in Afghanistan made a mistake when he gave the show a photograph of another soldier and passed it off as himself, the man's fiancee said Thursday.

The NBC series this week and WFAA-TV of Dallas last month used the picture with segments on Timothy Michael Poe, a former Minnesota National Guard member who said he was injured in a grenade attack in Afghanistan in 2009. The Guard says military records don't substantiate his claims.

The caption of the original picture on the official military website Defense.gov shows Staff Sgt. Norman Bone serving in Afghanistan in 2006.

Poe has declined multiple requests for comment from The Associated Press this week. But his fiancee, Carrie Morris, said Thursday that Poe accidentally submitted the photo to NBC and the station because he was hurrying and didn't take the time to look at which picture he was sending. She said he probably thought it was the right picture when he sent it to "America's Got Talent" because he already had sent it to WFAA.

Morris said she didn't know where Poe got the picture of Bone but that "he downloads military stuff all the time" and that other people send them pictures as well.

"But I know that it was a mistake on his part. It was an accident. It was a complete accident," Morris said.

Bone declined to comment to The Associated Press when reached on his cellphone Thursday, saying he wanted to consult with legal counsel because he's still on active duty.

NBC referred a call for comment to the show's producer, FremantleMedia North America. In a statement emailed to AP, FreMantle Media spokesman Neil Schubert apologized to Bone for the photo's misuse. He said it has been removed and won't be used again.

"It was supplied to us by Tim and used on the show in good faith," Schubert said.

WFAA assistant news director Chris Berg also confirmed Poe sent them the picture.

"Today they told our reporter they made a mistake and sent the wrong picture," Berg said by email. "Fiancee told us 'Tim forgets things.'"

TMZ Staff.. you do realize that this story is not an "exclusive", and the photo you posted above is NOT Timothy Poe, right? I know that you are aware of this because I know the man who really DID break this story- and told you that the photo is of someone else.

Funny that you are lying about a story about a man who lied.
