First Lawsuit

James Holmes mug shotOne of the victims in the James Holmes mass murder spree has lawyered up and plans to file a lawsuit ... because he feels the theater dropped the ball in a very fatal way.

Torrence Brown, Jr. was in Century 16 Theater when Holmes let loose.  One of Brown's best friends, A.J. Boik, was shot in the chest and died.  Brown, who was not physically injured, claims to now suffer from extreme trauma.

Brown has hired attorney Donald Karpel to rep him.  Karpel tells TMZ ... he is targeting 3 defendants.

1.  The theater.  Karpel claims it was negligent for the theater to have an emergency door in the front that was not alarmed or guarded.  It's widely believed Holmes entered the theater with a ticket,  propped the emergency door open from inside, went to his car and returned with guns.

2.  Holmes' doctors.  Karpel says it appears Holmes was on several medications -- prescribed by one or more doctors --  at the time of the shooting and he believes the docs did not properly monitor Holmes.

3.  Warner Bros.  Karpel says "Dark Knight Rises" was particularly violent and Holmes mimicked some of the action.  The attorney says theater goers were helpless because they thought the shooter was part of the movie.  Karpel tells TMZ, "Somebody has to be responsible for the rampant violence that is shown today."

im guessing he had seen previous batman movies before.. they arent exactly rated g.. to sue warner brothers b/c of a violetn movie is a far stretch and a little ridiculous at this point. Its a little upsetting that he would go this route.

Let the feeding frenzy begin. I thought ppl would at least wait for the victims to have their funerals? Blaming Warner bros? That's beyond reaching. His only value claim may be against The theater for not alarming the exit door.

In other words, let's sue everybody we can because I'm feeling "traumatized!" Maybe you should sue the people at the theater who didn't take the bullet for your selfish of them to want to live!!!!

This is just a jerk who is looking for a quick buck and found a lawyer who thinks someone will pay him just to go away. He and his lawyer are nothing but s***!!!!

The movie is heavily violent and someone has to be responsible for the rampart violence shown today, YET there Brown was, getting ready to watch this violent movie after having bought a ticket specifically to see the movie.

What a crock of crap! Way to cash in douche bag on the REAL tragedies of others. Might I suggest that if Brown is so against violence in movies, he stay close to home and stick to watching Barney or something.

The moment that theater owner posted a "gun free zone" sign he assumed responsibility for protecting every person who entered his business by usurping their right to do so on their own. He failed.

Freaken first of the ****roaches crawling out from under the s*** to collect a payday. Sure it was a horrible event. And of the 3 reasons he listed really the first one is the only one he has any chance with. Blaming his doctors? Yea ok so now we can just blame someones doctor if they do something, cause an accident, steals my ice cream whatever huh? And going after WB. WTF where you doing at the movie if violence is so bad? All the trailers and hype building up to the movie you can't say you didn't know it was a violent movie and that WB has any responsibly because someone shot up a theater where the movie was playing. Its a disgusting "Oh my something finally happened to me that I can get paid over" money grab. Not even trying to sue the actual shooter because they know he doesn't have any money . Hey why not go after his college? Or his landlord, or his parents, or his teachers, or his priest, or the girl that gave him his first blow job? They all knew him and didn't protect the world from him.

The movie theater yea you might be able to get something from them...the rest of the suit is nothing but a BS money grab taking advantage of a horrible situation. Maybe I can sue this guy...his trauma over the event resulting in the lawsuit is causing me trauma over abusing our legal system for personal gain.

Ok, you were traumatized - I get it. But you're going to sue the theater for not having an armed guard at the emergency exit - you're as insane as Holmes. Get a job.
