Heroin Charges Dropped

Jon Bon Jovi
's daughter will not face criminal prosecution after allegedly overdosing on heroin in a college dorm yesterday -- because the D.A. has dropped all charges.

A rep for the Oneida County District Attorney's Office says it is dismissing all criminal charges against Jon's 19-year-old daughter Stephanie Bongiovi as well as the 21-year-old male student allegedly involved with Stephanie's overdose.

TMZ broke the story ... Stephanie was arrested after being treated by emergency medical personnel following the alleged overdose at a Hamilton College dormitory. Cops claim a drug task force found small quantities of heroin in the dorm room ... along with marijuana and drug paraphernalia.

Stephanie was arrested for possession of a controlled substance, possession of marijuana and criminally using drug paraphernalia. The 21-year-old was also charged with drug possession. 

The D.A. says the charges were dropped because of a New York law that specifically prohibits prosecution of people experiencing a drug overdose -- as well as the people who help them seek medical care.

Well, that's the good news. The bad news, is that she is probably ruined for life, and will always be an addict of some sort. Heroin is not like pot, where you can quit cold turkey.

I don't understand the law. She was arrested for possession, not for experiencing an overdose. Maybe the search in these cases is unwarranted.

All charging these people would do (especially the friend who is likely the one who dialed 911) is convince people the next time not to try and get help.

SOmething to think of as far as the veracity of not just this story, but virtually every story that comes out of tmz - This is from the superfiscial:
The Smoking Gun has discovered the identity of Kevin Clash‘s accuser: 24-year-old Sheldon Stephens, a.k.a. “Sheldon Xzavier,” of Harrisburg, Pa. who, surprise, has a criminal record of floating bad checks and robbing people of jewelry at knifepoint. TSG also ****s on TMZ’s coverage particularly that Sheldon received a settlement because by the time his statement recanting the allegations was released, he’d already been dropped by his lawyers presumably for making the whole thing up:

Shortly after the statement’s release, TMZ scrambled to publish a story (citing “sources close to the situation”) claiming that attorneys for Clash and the accuser were, right then, purportedly “discussing a financial settlement and 6-figures were on the table.” At that point, however, Stephens was no longer being represented by Andreozzi & Associates, the Harrisburg law firm, and had no other legal representation. The issuance of the statement was done as a courtesy by Stephens’s former counsel, who noted that, “He will have no further comment on the matter.”
The acknowledgement that the damaging claim against Clash was not true came as a relief to the producers of “Sesame Street,” who, as The New York Times notes, “had been alarmed by seeing the words ‘under-age sex’ in the same sentence as ‘Elmo.’”
The recanting, however, came after TMZ had effectively outed Clash as a gay man. In a statement, the puppeteer noted, “I have never been ashamed of this or tried to hide it, but felt it was a personal and private matter.” It is unknown if TMZ, one of the country’s leading practitioners of checkbook journalism, paid Stephens for his story.

Sooooo........all charges are dropped, even though she was injesting and found to be in possession of heroin, but my boyfriend gets arrested, booked, and charged for smoking a roach, with no other drugs or paraphernalia on him. TOTALLY makes sense.

tell that to all the suffolk county ny druggies that have overdosed, and thanks to narcan that the police have been trained with and administer to people who overdose. Because when they come to, they are arrested. It's GOOD TO BE THE KING!!!

She should be treated the same as everyone else... This might not help her beat her addition...She has to hit her bottom to stop...
