0118_linday_lohan_01Lindsay Lohan doesn't care that the prosecutor in her car crash case is willing to let her skate without spending a day in jail ... because she won't plea bargain a case in which she says she's innocent.

TMZ broke the story ... attorney Shawn Holley was on her way to court Monday to negotiate a deal in Lindsay's lying-to-cops car crash case when she got her walking papers.  Law enforcement sources tell us ... the prosecutor was willing to let Lindsay plead no contest and agree to six months of lockdown rehab -- NO JAIL.

Presumably, the offer is still on the table but we're told Lindsay could not be less interested. She doesn't think she did anything wrong and will not plead to a crime she says she didn't commit.

FYI -- our law enforcement sources tell us ... prosecutors have her dead to rights, because she told cops she was a passenger in the Porsche when there's overwhelming evidence she was the driver.

So get this ... if the case goes to trial and Lindsay is found guilty, she faces 19 months in jail. On top of that, the lying-to-cops case has triggered a probation violation in her jewelry heist case and she could get ANOTHER 245 days for that.

It's hard to keep track.

Let her go to jail, what is this rehab as a deal. Who else but celebs get these deals offered to them. SEND HER DIRECTLY TO JAIL, MAYBE THAT WILL WAKE THE ADDICT WAKE UP

Since I don't pay 100% attention to the nuances of LL's legal travails, I went to look at up what will be addressed at the 1/30 hearing and found this in the Orange County Register:

Santa Monica Deputy City Attorney Melanie Skehar had said a new attorney from New York was selected to represent Lohan but lacked the necessary California Bar credentials, raising the prospect of the actress going unrepresented this morning, which would have led to a bench warrant for her arrest.

But in the end, attorney Shawn Holley, who has represented the actress in multiple criminal cases, was in court to enter not guilty pleas on behalf of
the actress. She exchanged a few words in open court with Superior Court Commissioner Jane Godfrey, then spoke privately with the judge in a sidebar conference.

Interesting, huh? So it would appear that the change in counsel was more involved than just a letter from Heller to Holley.

Lindsay should request prison instead of jail. Seems it's easy enough to get drugs in there. Just ask Michael Douglas's Son!

C'mon, Lohan signed the letter firing Holley that Heller sent. Wow look at the timing. Then Lohan tries to turn it around that she didn't mean to fire Holley. Again, look at the timing.

Holley sandbagged looking like a total fool in court. Lohans stupidity is that Holley is so well respected by judges as well as fellow attorneys that what Lohan pulled on her did her no favors.

Lohan thinks she's smarter than the attorneys and the judge. Lohan knows all the tricks, she's had plenty of practice. They know what's she's pulling.

Holley tried to recuse herself before.

Lohan has always had women judges and they all have let her off with a slap on the wrist. The women judges are a bunch of *******. The male judges, I don't think they would fall for her fake tears and bogus promises. Throw her in jail where she belongs. Or maybe, just maybe, they are not throwing her in jail, because they are just waiting to see how long it will take for her to almost kill herself or someone else because of her wreckless behavior. Either way, it sucks to be Lindsay. Her name alone paints a picture of her being a liar, a thief, a drug addict, chain smoker, unprofessional, delusional, brat who can't hold on to a job. Wow.

Pre-trial hearing (lying to LE): Jan 30
Probation violation: Feb 10
Trial for lying to LE: Feb 27

"A judge ordered Lohan to personally appear at a pre-trial hearing on Jan. 30, and set a probation violation hearing for Feb. 10."

"A February 27 trial date has been set for Lindsay Lohan on four misdemeanor charges connected to an auto crash in June"

Is the recent ROL story about Lindsay stealing a bracelet of Taylors from some nurse on the Liz and Dick set true, and if it is why were no charges pressed? The nurse was apparently really upset by the whole ordeal, and to top it off Lindsay had the nerve to tell her that Liz would really upset by the way she was acting. I mean I would have just called the cops on the bitch after that and filed a police report for the hell of it.

@ SuzyQ I'm a little confused by your discussion of judges vs. commissioners. Are you saying that Lindsay's situation was affected by the fact that her case was heard by a commissioner rather than a judge? Or are you saying that the term judicial officers should be used as it encompasses judges and commissioners?
