Sues Walmart Over Crash

You Overwork Your Drivers

0712-tracy-morgan-tmz-01Tracy Morgan was severely injured because Walmart allowed one of its drivers to become so exhausted behind the wheel an accident was destined to happen ... so claims Morgan in a new lawsuit.

Morgan filed suit in New Jersey alleging the company should never have allowed truck driver Kevin Roper to drive for nearly 10 hours straight after being awake for more than 24 hours.

The suit -- reported in the NY Post -- claims Tracy sustained, "severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”

According to the lawsuit ... Roper had driven 700 miles from his home to the Walmart distribution center before beginning his fatal drive.  One person died when Roper was tooling along in his tractor-trailer at 65 in a 45 MPH zone and slammed into the SUV.

Roper pled not guilty to charges of death by auto. Morgan was released from the hospital last month, but he's still at a physical rehabilitation center.

Tracy -- and 3 other plaintiffs -- are seeking unspecified damages.

Walmart tells us, "As we’ve said, we’re cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved."

Wal-Mart is a disgrace. They need to pay each of the victims $20 million each and call it a day. That won't even make a dent in their net worth.

IN MY OPINION    

There should be a LOG that keeps track of when the drivers work SO it IS Walmart's responsibility to ensure that the drivers get a break in between long distance driving. STOP OVER WORKING YOUR DRIVERS.

When I worked at Walmart, it wasn't at all unusual to see someone leaving at 11pm and say they had to be back at 7am!!! :/

WalMart has the Big leagues in lawyers. NJ is a no-fault state. Wmt can drag this out for a decade and the lawyers for Fat clown act will be in an old folks home, his lawyers know this. They really want a quickie settlement arbitration. Lawyers who take his case are rolling the dice,bluffing,and if wmt says we will play it out, the ambulance chasers will be back suing grocery stores

All trucks have on board GPS so they know exactly where that truck is on the road 24/7, all they have to do is subpoena all records and know exactly how long he was driving. Seriously do not believe he was driving 10 hours or less and sitting doing nothing for 12+.

He is right suing Walmart and not the driver. Every trucking company in the country takes advantage of their drivers. If he had told his dispatch he was too tired too drive he would have been fired or there would magically be no work for him for the next day or two. Each of those trucks has an electronic log wired directly to the truck, but with the click of dispatches mouse they can make a days worth of driving disappear. Their job(dispatch) is to make sure the load is on time and efficiently as possibles and will do whatever it takes to make that happen.

It's NOT Wal-Mart's fault that their driver was exhausted, that's the driver's fault.

The driver CHOSE to take the run and be up for 24 hours, not the other way around.

It's the drivers fault period, ultimately it's his responsibility to get rest. I bet if he was white morgan would be suing him too.

Suing Walmart seems like the next logical step for a disabled comedian. He cheated death, so now he can cash in from a big name who will look bad if they don't pay up.
