Prosecutors Split in Brandy Case

BrandyLaw enforcement sources tell TMZ that officials in the Los Angeles City Attorney's office are split over whether to prosecute Brandy for a fatal car accident last December.

Brandy's Range Rover rear-ended a car, triggering a multi-car accident, which resulted in the death of a 38-year-old woman. One source says there was a "conflict" in the City Attorney's office over whether Brandy should be prosecuted at all. The charge on the table, we're told, is misdemeanor vehicular manslaughter.

We're told prosecutors are waiting on technical data that will measure the speed of Brandy's vehicle on impact. The data will help prosecutors determine if the singer tried to brake before impact. The tests are being conducted by a London based firm.

When the results are returned, the City Attorney will make a decision. One source says, "At this point it could go either way."

61. They should investigate her cell phone records to see if she was on the phone at the time of the accident. If so, she should do time.

62. umm...i dont get it...people don't realize that this was a very tragic accident....but it could happen at anytime, to any one of us! and don't we know that every time we get in a car? are we going to start charging people with attempted murder or manslaughter everytime someone rearends someone? she wasn't drunk or on drugs, she should not be charged. of course she is going to get sued but this shouldn't go on her record and she shouldn't go to jail.

63. Brandy wasn't using drugs or alcohol, and she wasn't using her cell phone during the accident. The police have officially rules any of these allegations out.

65. This is a very sad case. What's even sadder is the people are making racial comments related to this incident. Celebrities get breaks all the time, It doesn't matter what their race is. Stick to the facts. There is good and bad in ALL races, not just blacks! Pretty interesting how the average serial killer is white and while the average black gets thrown in jail for petty theft, the whites get a slap on the wrist for embezzelment. So in esscence they play their race card too. Crime is crime and has nothing to do with race.

66. That camel-toed Ho Brandy need to pay for her carelessness. She drove a car that caused an accident that caused a death. Murder it isn't, but she has to have some kind of punisment. And I don't mean just a fine and community service.

69. hey jim, paris didn't go to jail for blowing a 0.08, she was put on probation. she went to jail because she violated that probation on at least 3 occasions (those were only the ones where she was caught) . you or i would go to jail for a lot longer....probably atleast 3 months for the same violation.

Drugs, alcohol, and yes, the dreaded cell phone have all been ruled out as cause of the accident. Poor driving is definitely the culprit in this case.

We all have done stupid things on the road, we just so far got away with it.
She needs more driving lesson's and education about driving, NOT jail
NOBODY goes out with total intension's to kill, her distraction's unfortunatly did.
