Files for Divorce

We've learned Mel Gibson's wife Robyn has just filed legal papers to divorce Mel Gibson, her husband of 28 years, citing "irreconcilable differences." Pretty ironic -- Robyn signed the papers the day before Good Friday.

Sources tell us there is no prenuptial agreement -- they were married in 1980, before Mel Gibson amassed a fortune estimated at $900 million back in 2006. Under the laws of California, community property -- which includes earnings -- is divided 50/50.

The Gibsons have 7 children, but only one -- Tom, who turns 10 tomorrow -- is a minor. In Robyn's legal papers, filed this morning in L.A. County Superior Court, she seeks joint physical and legal custody of Tom.

Robyn is also asking for spousal support and attorneys fees.

Robyn lists the date of separation as "to be determined." This is important, because earnings generally cease to be community property when the couple separates. There could be a skirmish over this. We're told the couple grew increasingly apart over the last few years, especially since Mel's drunk driving arrest in 2006.

There have been reports that Mel has been involved with another woman, which the actor denies, but we're told the reasons for the divorce go beyond any third party.

Launch PhotosIf there is a fight, Robyn is in good hands -- she's repped by disso-queen Laura Wasser, who has handled divorces for the likes of Angelina Jolie, Britney Spears and Stevie Wonder.

UPDATE: Robyn and Mel Gibson just issued a statement: "Throughout our marriage and separation we have always strived to maintain the privacy and integrity of our family and will continue to do so."

Sources tell TMZ the couple has been separated for more than 2 1/2 years. We'll see if Robyn agrees. Again, the separation date is important in dividing assets.

4. Here's the logic. He's a schmuck, he probably made her life miserable for 28 years, he's been photographed with other women often during that time, he's a religious hypocrite--bordering on insanity and religious mania--and he controls the purse strings. He's publicly stated how bad he feels that his wife will be going to hell, since she is not a Catholic, claiming that this is God's will (what sort of God is this man worshiping?) Damning the mother of your 7 children to hell is not a sign of mental stability. The man is pathological and untrustworthy. It's not really so hard to figure out why she may be trying to protect her financial future.

Gone are the days when I had such a crush on the then young Mel Gibson. His devotion to his wife only added to his attractiveness, but time has told and his behaviors since the Mad Max days have served to undermine his sex appeal and overall demeanor as a nice person. I can only imagine that the reason his wife stayed this long was due to their Roman Catholic beliefs and their numerous offspring. It is telling that, in the end, getting out of a marriage is more important than adhering to religious beliefs. I'm agnostic, btw......I disagree most vehemently with Mel's conservative b.s. and now view him as a moral hypocrite. His wife could probably apply for sainthood.

The whole 50/50 thing is a load of crap. If you didnt earn it then you getting a free ride and free loaders dont get anything. She deserves enough to live on until she gets a job then she has to take care of herself on her own. Thats the only fair outcome.

Time for Mel and Robyn to watch the Passion of Christ movie.. They both need to humble themselves before God and their marriage should be restored so they can be an example of Forgiveness, Mercy, Redemption, etc

How quick everyone is to judge Mr. Gibson. Is there no one who has ever been "over" intoxicated from drinking to much to try to blot out the "unwanted problems" that are consuming your everyday thoughts in the hope you can forget them for a minute or two? Why such hateful comments on this man? Only someone with a deep faith could have made such a heart wrenching film as the "The Passion of Christ". I'm sorry to read of the pending dissolution of his marriage. His wife undoubtedly reached her limit of watching him destroy himself with alchohol. I believe that he's truly sorry for his behaviour and if Christ can forgive him you can too. I think he has been shocked into "realism" by his arrest and seen his drunken behaviour video of his arrest. What Mr. Gibson needs is your sincere prayers for his recovery and strength to continue his recovery from alchohol. He has my sympathy not anger. He'll also have my prayers . You know it's okay to say "let it go" etc., and "how sad" blah blah blah. But when you've got an individual who professes to be so Catholic and is so pious and obnoxious about his religion ... no, can't let it go. He's a hypocrite. It has been my experience that those people who profess to be so high and mighty, are the biggest sinners of all.

A $900,000,000.00 estate? Spousal mainteance? And how much can that be??? So many divorces are over the lack of money and who gets the debt... Split it up and go down the road. It's difficult for REAL people to comprehend your situation. Chalk up a good run (Hollywood standards) and find someone new. It's doubtful that will be a problem.

I think its always sad when a marridge doesn't work, because in more cases than not,...both parties end up getting hurt. that being the case, I think they should just agee to disagree and part as peacably as possible, and not try to perpetuate an already bad thing by inflicting more pain.
Incidently, I don't agree with dividing everything down the middle, andbesides,she doesn't need spoucel support with over 400,000,000 dollars in her account!! Thats shear bitterness. Theres no such thing as one party or the other being totally right or wrong. Both have inconsistencys that at some point they obviously desided not to work out, both of you just go your separate ways and leave each other in peace for ''God's" sake. Isn't there enough bitterness and hatred in the world to deal with with-out inflicting it on the ones you love?? None of us are perfect, learn to for-give....."STASH"

Interesting, considering they have always espoused a devout, almost fundamentalist Catholicism. I guess one's faith is only to be adhered to until it's inconvenient. I personally don't have a problem with a divorce (nor am I Catholic), but I do have a problem with the hypcracy. If divorce is not allowed by your faith, and you swear by that faith, then how is this reconciled? I feel for the woman if her marriage is bad, but if you're a strict Catholic then that is the "risk" you take when you embark on a marriage.

I HATE to see when ANYONE splits up. So many difficulties can be overcome, but they both must desire it. They probably got into an heated discussion recently and she filed the papers. You can't put something back together being apart. Twenty Nine years is a LONG time to be married. I'm saddened by it and wish them both the best. I think its so funny so many people "Know" whats going on in this marriage as to say who/what is at fault. You dont know crap. You are showing your lack of intelligence and maturity by your meaningless dribble. Good luck to you both, Mel & Robyn you will need it. God Bless Tom and watch over him.

Oh....another marriage down. Mine ended a few years back. Kids still suffering. It is never the same. My husband married a woman 23 years his junior. I am not an old hag either......BUT, the men think they need to grab their youth all over again. I just wish someone would ride it out. Don't be too hard on Mel. He is after all, just human and imperfect. I am certain these two people tried hard to make it work. Sad, very sad. Hope Mel sees beyond this Oksana woman. Way, too young for him in the end.
