TMZ has just obtained this shot of Mel Gibson with GF Oksana Grigorieva inside Playhouse in Hollywood last night -- before he allegedly got too hands-on with a photographer who tried to take their picture.
Someone is at the LAPD's Hollywood Division right now filing a battery report against Mel -- who reportedly became irate at a photog and ripped the guy's shirt open.
Gibson -- who had an infamous DUI case in 2006 -- is currently in the midst of a pricey divorce with estranged wife, Robyn.

A shirt, he ripped a FREAKING SHIRT people! This is considered "battery" in California? This would BARELY be summary harassment in other states! No wonder the paps are fearless in their invasion of people's rights. Not only are they free to stalk, harass, annoy, and provoke celebs, if the celeb does the tiniest thing in retaliation, they get popped for felonies and misdemeanors. Man CA has some retarded laws.
