Anna Nicole's Daughter

Supreme Force

4/8/2010 6:11 PM PDT BY TMZ STAFF

Anna Nicole Smith's daughter may only be 3 1/2, but her lawyers are all business, threatening federal judges to either reverse themselves or get ready for a dose of Supreme Court humiliation.

0408_ans_ex_getty_01

Lawyers for Anna's estate -- who effectively rep Dannielynn -- just filed legal papers with the federal appeals court that shut down the estate's claim for a big piece of J. Howard Marshall's fortune.

In the papers, filed today and obtained by TMZ, Dannielynn's lawyers note that the same three judges who shut them down last month did the same thing years before, only to have their decision reversed by the U.S. Supreme Court.

The new legal docs are a not-so-veiled threat to the entire 9th Circuit Court of Appeals. Dannielynn's lawyers want 11 judges on the 9th Circuit to review the case and side with the cute little kid. The lawyers warn ... if the 11 judges don't heed this advice, they will be embarrassed when the U.S. Supreme Court tells them for a second time they're all wet.

Come on, people. Give the guy a break. He needs to trade in his 2008 top of the line Range Rover for a 2011! He only drives his 140,000.00 2009 Porsche for special occassions with his 'lover'!!!!! Why should Larry do like the rest of us (except for Octomom and Kate G.) and get a REAL job when you can exploit your children. Anyway, I'm very very stressed out that his family Range Rover will be 3 years old and he may have to drive it another year. Please just give the guy the money he so deserves. Please. I don't know if I can go on much longer. anyway, got to get ready to go to work. I'm not as fortunate. I have to work a real job to support my 2 children.

Actually the baby looks like Larry, he's a very handsome man, which makes this little doll pretty from both parents!!! Good genes in the beauty department not so much in the health department!

I hope they do get some of the money they are claiming, after all it was Anna who legally married the old Marshal guy and gave him the best last days he had in store! The little girl is entitled to the money her mother worked for!!!

My Gosh ! ! !

Don't the Marshalls have enough money that they could "share". Anna earned the money just by putting up with that old man. He didn't have to marry her and she resisted for years and then finally married him. To put up with him would be worth millions.
I am tired of these dirty old ugly men wanting these beautiful women and then cheating them out of some money to put up with them.
by gosh she earned every cent the lawyers are trying to get for her daughter. I am tired of these stingy millionairs cheating the rest of us out of something we have coming for putting up with the likes of them. Ugly Marshalls ! ! ! !

Marshall's never offered a settlement to Smith. They have said from day one that J. Howard provided (7 million) for her while he was alive and nothing after his death, a jury confirmed this in it's decision after a five month trial.

The current decision by the 9th circuit was a brilliant written opinion which provides an excellent review of "the evolution of the current bankruptcy regime in order to appreciate the important distinctions between 'arising under,' 'arising in,' and 'related to' proceedings and how the notion of 'core' proceedings came to exist." The analysis of how "counterclaims by the estate against persons filing claims against the estate"―that by statute (28 U.S.C. § 157(b)(2)(C)) are defined as "core"―can still be narrowly construed as non-core "in order to avoid potential constitutional problems arising from having Article I judges issue final orders in cases requiring an Article III judge." Even compulsory counterclaims may not be "core" proceedings, the Court held.

She is probably better off without the money. Who has that ever really worked out for? Given the tragic circumstances of her mother, money will only make things worse for her when she gets older. Larry needs to just concentrate on keeping her grounded. If she starts chasing after her mother's memory with the funds to do it, it will be a disaster!

what a joke

all ppl seem to do is bash Anna Nicole/ Vicki for being a gold digger/ stripper. She came from nothing and was a model for Guess and Playboy. She may have started out as a stripper but she didn't remain one and go around husband stealing and homewrecking. She had no one there for her when she was growing up and had a hateful, vicious mother with an absentee father. Don't be so quick to judge. She did what she had to do and while she was filming her reality show, she supported everyone who lived in that house, Howard the mooch included. he was a grown man who should've been able to provide for himself but he let a woman pay his way. and he let her to her death. She never had anyone she could rely on other than her son, Daniel. So sad. The only man she could ever depend on was her kid. It's also sad how so many in Hollywood were quick to write her off as white trash but she made her own money by modeling and acting. She wasn't born into hollywood royalty like Paris and Nicole, she struggled for all her money, they all liked to take shots at where she came from, despite the fact she did become famous on her own, no relatives helped her but they all came calling when she made it. sad. You will never see anyone taking shots at the Hollywood royalty kids that are famous because of whose gooch they came out of but yet if you come from humble beginnings and still make a name for yourself, they enjoy reminding you, you are still not one of them. That is so wrong to me. and to the ppl that say she had no business marrying that old man. guess what? he used her, too, I'm sure he had his fun. He didn't make his millions by being stupid and naive, he knew the deal and was ok with it. I hope her daughter gets to live the happy, loving, secure life that eluded her mother her whole life. so sad.

Have always wondered why Anna didn't get her HUSBANDS's inhereitance, every other wife gets hers. It never made sense to me, i mean, she married him , uh, hello, in the eyes of the law they were man and wife; what does it matter if he married her for her beauty, and she married him for the life she deserved ? This entire saga could have been avoided if the Marshall family just gave her what she already owned .

Now she'll never enjoy the fruits of her labor.

Let 's hope that the 'CULPRITS" in this tragic story, get life.

This, as always, is my sincere Humbolt opinion.

#80 --- Splat ! Are you kidding ? If you followed the story after ANS death you would have heard from the horse's mouth, her arch nemisis Randy? the Marshall lawyer who offered words of condolences for ANS death. It was during that interview that he stated that the family would more than likely make the $88 million dollar offer to the Smith estate to ensure the child was taken care of under the circumstances. The legal issues surrounding ANS were many, it was hard to untangle, and its now used as case law in law school's across the country. But it was on live TV that Randy made that statement, I didn't have a dream about it. And please with the $10.00 words you just used it makes you look stupid when you can write down to people. Wonder how you talk in real life, talking down to people to make up for some other insecurities I'm sure.

#80 Splat --- Are you kidding ? After ANS death the Marshall lawyer, Randy ??, was on TV offering his condolences and talking about how bad he felt that she had died. When questioned about the Marshall suit he stated that the original offer of $88 million would probably be offered again to the estate of Smith as a gesture to ensure Dannilynn would be taken care of during her lifetime. If you recall the hype of her death, the non-stop daily coverage and the shock and surprise of so many that her death created and all the legal entanglements, his words were documented live on TV. And stop using those $10.00 words, it makes you look stupid to talk down to people.
