I don't know how these things work, but if he were talking about anything other than Lohan's incarceration tomorrow, the process and terms, I believe the prosecutor should be present at any discussion. I feel sure that the judge and Shapiro are not planning any "get Lindsay out of jail" shennaigans, not without the prosecutor present, unless TMZ missed the prosecutor's attendance.

The DA would have to sign off on any private meeting with the judge. Otherwise it would be judicial misconduct. Of course the DA hasn't exactly been vigorous in enforcing the rights of the state, given that the sentence they asked for was much less that what the judge finally ordered.
