Will Dodge Jail Bullet

Lindsay Lohan will not have to spend the next 30 days in jail ... sources connected with the case tell TMZ.

There was a buzz in the case that Judge Elden Fox would have Lindsay jailed tomorrow -- without giving her bail -- and make her sit behind bars for 30 days until the next hearing. The danger for Lindsay -- she would have to serve the full 30 days and would not be released early because of jail overcrowding.

But insiders tell TMZ ... if Judge Fox remands Lindsay into custody he must set bail, because the underlying offenses are all misdemeanors.

So here's the way it will go down ...  Our sources say tomorrow's hearing will be extremely short.  There won't be any arguments over the case.  Judge Fox will schedule the formal probation violation hearing, and almost certainly remand Lindsay into custody and then set bail. But you can bet a bail bondsman will be right there in the courtroom to take care of business on the spot.  So Lindsay will walk out a free woman tomorrow.

When the probation violation hearing is held next month, it's likely Judge Fox will sentence Lindsay to 30 days in jail based on the failed drug test for cocaine.  As we first reported, the Probation Department will not recommend jail time for the second failed drug test because of an ambiguity in the paperwork.

But this 30-day sentence would be subject to the realities of jail overcrowding, which means Lindsay would go to jail for booking and probably be released an hour or two later.

The upshot -- looks like Lindsay will dodge another bullet.

Eh so what. If JAIL is the only thing supposed to keep her from drugging every day, then her life is pretty much over - professionally, financially, etc. anyhow.

BTW, nice reporting TMZ. Where was that exxxxxpert two days ago when you reported the opposite. Isn't Harvey a Lawyer?

I don't think the bail will be as high as the previous amount of 100k because she was in Cannes and missed a hearing then.
She will take paying the bondsman over sitting for jail in 30 days with no release.

Oh no. Here we go.

I dont know why you guys are so upset. She is simply playing by the rules of the justice system. The constitution gives everyone the right to a reasonable bail. She WOULD be put in jail but she is able to post the bond. The repeat offenders that you guys refer to who are stuck in jail are only in there because they cannot afford the bond. They have every opportunity to be released as well. She is a low level offender who poses no threat to the public.

Amazing...absolutely amazing. If she doesn't do any jail time she'll continue to do reckless things...and I'm afraid the loser will probably OD in the near future...either that or kill someone in an accident while she's wasted.
Actually, #16 has a good point: How does jail overcrowding apply if she's held in a "private" cell?

To #33 susan - You can move here if you want, but if you get in any trouble with the law, you will do the time handed down to you seeing as you are not a celebrity. I've lived in Los Angeles all my life and have seen many celebs get off just because of who they are.

Doubt she would flinch @ the money she's got to spend. She just go a big payday for suing someone for pointing out the obvious.

Maybe that'll be her next big career move. She'll sue everyone who calls her an addict. Needless to say, she'd become a billionaire.

EXACTLY... I guess as long as they get money, you can do what ever the hell you want - for Lindsay, her record is already tainted so I doubt she cares.
