Mel Gibson --

Domestic Violence

Not on His Mind

9/28/2010 11:00 AM PDT BY TMZ STAFF

Mel Gibson and his legal team were not trying to suppress evidence of domestic violence when they agreed to pay Oksana Grigorieva and Lucia approximately $15 million in return for the destruction of "evidence" -- they were trying to prevent the destruction of Gibson's image  ... sources connected with the mediation tell TMZ.

0719_Oksana_Mel_getty_ex_03
Oksana's current legal team claims the mediation agreement is not binding because lawyers cannot agree to destroy evidence of a crime.

But here's the rub: Sources tell us the photograph of Oksana -- showing what appears to be either teeth or veneers missing -- was not part of the deal.

Sources tell us Mel and his lawyers never thought domestic violence was even an issue.  As we first reported ... Mel's team claims Oksana and her lawyer made it clear -- the $15 million was a payout to keep the racial and other disgusting remarks Mel made on the tapes secret forever.

We've learned Oksana's lawyer said in the mediation that photographs of Oksana's mouth existed, but when it came time to define "evidence" that would be destroyed, the photos were not included. So the argument goes ... if Mel was trying to destroy evidence of domestic violence, why didn't he demand Oksana hand over the photos?

It would be nice if that brood-cow, Robyn, would be honest about Mel's temper. Of course she can't - their divorce is not final!

Many statutes also provide that any threat to harm another person in his or her career or reputation is extortion.

Whatever lays behind the phrase "evidence" & whatever was communicated, it's interesting that Mel's official camp has now come out of their hole & realize the need to give statements to to public media.

Mel seems to be declaring "100% innocent" concerning any kind of domestic violence. Anyhow, it would be hard to deny from the recorded rants, that he has not bordered some kind of criminal act, as his verbal threats & insulting speech are at least strong evidence that Oksana could not feel safe relating to him.

Whether the total evidence & the testamonies in court are strong enough to indicate DV is a matter for the judge. But being totally unaware that he had the risk of being accused for DV or that Oksana felt unsafe concerning the custody, must be a game for the gallery I'd say, to be expected of course, as even the slightest concession could rock the boat.

But you had some damaging rants Mel, hadn't you?

he admitted about the ranting, obviously he haven't hit her, if he did, he would have put the teeth pictures to the codicil. He know the picture existed. If he wasn't worried about it Sorntolc, probably because he was not responsible for what happened to her veneer. He won't be jailed for verbal ranting,
he might be put on probation and do some community voluntary work. Even that, I don't think will happen. My best bet the judge will order Mel to have anger management therapy, which he already made that steps when he asked Collingwood from Perth for series of hypnotherapy.

He is a lot calmer after that treatment, coming out from toxic relationship done wonder to his health too.

More typically, extortion is used to mean illegally compelling someone to give you their property by instilling fear in them that you will expose a secret, harm someone, damage property, accuse someone of a crime, or perform some other act designed to harm the parting you are extorting.

Oksana purposely recorded conversations of Mel Gibson with the intent of selling the recordings. She intended to threaten Mel Gibson with these recordings demanding money from him. She demanded on several occasions that Mel Gibson pay her and her family millions of dollars, money that she deserved. She made the recordings with the above intentions and more. She made several false statements and agreements concerning the release of the recordings. Usually when the FBI is alerted to something of this nature they ask to work with the victim in order to secure definite evidence against the criminal. In some cases legal authorites may see the crime to it's full fruition including the transfer of money in order to demonstrate intent. Fortunately for the state there are several methods for displaying intent of a crime.

OG made illegal tapes and MG wanted to keep those illegal tapes private since they would reflect badly on him especially after his problem a few years ago. People hated him when they were first leaked.
OG got the deal of $15M with those illegal tapes. DV was never on anybody’s mind, not even on OG’s because there was no DV. Somehow she changed her mind and wanted more money; make up DV and the photos.
I am not a fan of MG, but after this, he is actually a better dignified person than I thought. Not waging smear war in public, not releasing private information or attacking OG, OG just embarrassing herself by dragging on.

•The law of evidence governs the use of testimony
•Evidence" is a science fiction short story by Isaac Asimov.
•"Evidence" is a song by Faith No More
•Evidence is the fourth album by Steve Lacy
•Evidence in its broadest sense includes everything that is used to determine or demonstrate the truth of an assertion
Evidence does not necessarily mean a crime has been committed.

And get used to the thought that it was Mel who extorted Oksana, while he tried to force her into destroying those infamous recordings. To obtain this he both flattered & threatened, safeguardening himself but not really her, so Oksana walked out in the end, leaving the matter to the sheriff, better than an unsafe agreement.

That what "WE" Team Mel was saying for weeks.

Oksana kept blaming Mel for her waning public supports, even the media lost interest in her.
She can't accept that she is mostly to blamed for her downfall.

Evidence (in criminal law, an assertion of guilt or of innocence)

How ever this was a custody agreement not a criminal proceeding.

Mel did I miss the part you were asking for money? Or were you just trying to get illegal recordings of your own voice and thoughts out of the hands of an extortionist?

Thought so

Quotes from interiew with Daniel Horowitz on TMZ:

"She was beaten, she was terrorized, and yet all the media seems to focus on whether she extorted Mel Gibson, when in fact it’s just the opposite."

"Anybody who is beaten or threatened has a right to do***ent it and show the world that this is what happened. Otherwise it’s going to be Mel Gibson, one of the most popular, loved superstars in the world against a lone woman. Who is going to believe her? She has the right to prove that this really happened to her."
