Bret Michaels Sues

The Tonys Almost KILLED Me

3/25/2011 7:00 PM PDT BY TMZ STAFF

Bret Michaels blames the 2009 Tony Awards for causing the brain hemorrhage that nearly killed him ... after he was whacked in the head by a piece of scenery while performing on the show.

0325-brett_tony_EX_TMZ
Michaels has filed a lawsuit against Tony Award Productions, CBS and others ... blaming producers for not instructing him on how to safely exit the stage after his performance was over ... because while he tried to exit, he was "smacked" in the face by a piece of the set.

In the suit, filed today in L.A. County Superior Court, Michaels claims he had to be hospitalized for a broken nose and a cut lip.

Six months after the awards, Bret nearly died from a subarachnoid brain hemorrhage -- and the rocker insists it was NO coincidence.

In his suit, Michaels claims, "One of the most common causes of this type of hemorrhage is head trauma -- exactly like the one Michaels suffered at the hands of the Tony Awards."

0325_bret_michaels_video_smallMichaels notes, "Through his sheer will to live, to see his children grow up, [he] was able to survive this trauma."

Bret says producers have "failed and refused" to remedy the situation ... and even blamed him for the mishap at the Tony Awards, claiming he "missed his mark."

Michaels is suing for unspecified damages. A rep for the Tonys had no comment.

Once again, The penalty for "missing your mark" should not have been death or great bodily injury. For godsake he is not Evil-Kneival.

Chicagoray

Quick story: in 86 had a car accident as passenger in Corvair, back engine. thrown entirely through windshield like a missile and woke up on hood of car against the grill of a blazer remarkably unharmed but for some scratches and a concussion, little blood. We thought.

A year later, college graduation 87, one month after having headaches all senior year and thinking it was just working at both ends for the first time, go to hospital to find a lemon sized brain tumor right temporal lobe, days to live. Brain surgery, they don't know if it's malignant or benign so they read me my last rights before the operation.

Wake 2 weeks later with the most brutal headache 10 X worse than they were, from the operation of course, dr's come in with family start quizzing what's happened to me over the past couple years, they say 'we found a sliver of glass in this lemon sized abscess", I confirm yea I was in an accident blah blah.

Parents start to look to sue in 87 and my dad was CEO of PET Inc in ST Louis with dough and lawyers at our disposal and none would take the case because there was no way to prove the sliver was from this accident, even though everyone concurred that's what it was.

No payday for me and now 20 years later my left side is crippled from the surgery from the waist down.

If this guy gets paid for this, our country has lost it's way and we'll never find it's way back. We should send 90% of the lawyers today to the bottom of the sea. Sorry Harvey but leeches is a kind description, they make up laws just so these people have something to do. GOD HELP US ALL>

GOOD for him! I have been expecting him to put all of these pieces together and file a lawsuit against all of them.

I support this effort and Bret 100%.

Perhaps Brett should have shown up to rehearsals so he would have been familiar with the set. The accident could have been avoided. Blame it on "stupidity" on HIS part.

Actually, Brett has every right to sue the producers -- it is their responsible to keep the premises free from any hazard that could injure any of the people they have onstage. However, Brett would really have to show that the injury he suffered was because of the producer's negligence, otherwise, if the subarachnoid brain hemorrhage he suffered from was because of an existing medical condition he had and not because of the injury he sustained, then his lawsuit will fail.

This has nothing to do with your personal feelings towards Brett Michaels .... When you injure somebody, you are guilty of committing a tortious injury .... A person who suffers a tortious injury is entitled to receive "damages", usually monetary compensation, from the person or people responsible — or liable — for those injuries .... Even if everybody in the world doesn't like him and even if he has tons of money .... Being rich and unpopular doesn't mean people can whack you over the head, accidentally or not .... In my opinion, the production and stage crew was entirely responsible .... That over-sized prop was going way too fast .... He had no idea it was coming .... They should have made sure he was clear before they dropped that wall .... A LOT of you are making comments that he is so wrong for filing the lawsuit, but I am 100% positive that you would sue if this happened to you .... By the way, aneurysms don't happen in real time, they take time to develop depending a number of factors after an injury .... I know this from experience from 2 different people who had brain injuries and both of them later had aneurysms .... For some of you fools with no knowledge of this type of situation, think before you post.

Dude

Oh the irony of the theater. lol Bret should have done what I did and not watched the Tony awards, and he would not have had that problem. It was Bret's fault for showing up to such a stupid event. The Tony award show is a waste of time. I could have told him not to go. :) ha ha ha

What a loser. He couldn't just suck it up and move on knowing that he walked away with his life. Now he needs to pay his medical bills and I guess the easiest place to look was the lawyers office

I find it more likely that his stupid wig and his fetish for married women caused his brain injury

This is nothing but a money grab since VH-1 isn't paying him to be on any more crappy shows.
