Jalen Rose's lawyer is LASHING OUT at the Michigan judge who just sentenced the former NBA star to serve 20 days in jail for his March DUI ... claiming the sentence is an "abuse of discretion."

Attorney Keith Davidson tells TMZ, "The 20-day jail sentence issued today by this Michigan judge is outrageous."

He adds, "Today we saw a horrendous example of judicial temperament and discretion."

Davidson insists Jalen is a "model citizen who has personally donated millions to charity, established inner city charter schools and a medical center in the Congo" and most importantly ... "has NO PRIOR criminal record."

Davidson adds, "[Jalen] was the victim of abuse of discretion; lack of proportionality in sentencing; legislating from the bench & instituting illegal minimum mandatory sentences for DUIs in violation of law. "

"Mr. Rose is examining all of his legal options based on today's events."

Relevant Fun Fact: In Michigan, there's NO minimum jail requirement for first time DUI offenders.

If he was such a "model citizen" he probably wouldn't have gotten the DUI in the first place. Stop your b1tchin', at least you're not in AZ where first offense is 30 days in the tents, 12 months with a breathalyzer in your car, ridiculous fees, License gets suspended for 90 days and you have to take pee tests to get your License reinstated. Yeah, you got off easy.

It is about time these judges get tough with DUI's. It might be his first offense, but all it takes is one time and someone might die. It could be one of your loved ones. How would you feel if he killed your child?

I think you guys should note that his judge is one of the TOUGHEST judges in the nation for 1st time drunk drivers... he got about what she doles out on average.

Judge has discretion up to 93 days. 94 is abuse of discretion. This is abuse of grandstanding, Mr. Davidson

Mr. Rose didn't get pulled over or randomly stopped for this offense. He crashed (actually rolled it, if I recall correctly) his vehicle. Community service is not a punishment for him, since he is (by his lawyers own admission) active in community service in the inner city. A large fine would not serve as punishment either since he is loaded. I believe the judge used his discretion in he sentencing so that the punishment would fit the crime for the offender. I feel this will have the most effect on Mr. Rose and prevent a recurrence.

Take notice, California. This is how you treat first-offense DUIs. Actually, I would make him pick-up trash alongside roadways for a month instead of giving him 20 days alone in a jail cell doing nothing.

Alisa...where did you go to school? I can't figure out what the hell you were trying to say. And what world have you been living in. When do you see or heard of anyone going to jail for their first DUI must less someone with a clean record prior to that? Unless this judge sends EVERYONE to jail for DUI REGARDLESS of priors or whatever...Jalen shouldn't be the Poster Boy for DUI's. And to be honest...I'm not even a Jalen fan.

I agree with David Jong...look at his entire body of work. If he's notorious for sending people to jail for first time DUI's with NO CRIMINAL record...then you have to charge it to the game. But if things don't add up...you have to throw "the card" out there. Its plain as day at that point.

A model citizen who drove while under the influence and could have KILLED someone! Two things are now non-existant: his clean record and his model citizen status.

And bitching about 20 days? Really? He could have killed someone and spent a heck of a lot more time in jail for that. 20 days will probably equal to 5 and he'll be out and done with it all. Uh oh, do I hear Rev. Al Sharpton? Isn't he usually nearby when a black man is being treated fairly, complaining that it's unfair? Where's he at?

That's why people are moving away in droves from Michican't. Here is a guy who has a foundation, does a tone of charity work, and gives back to society. Makes one mistake not hurting anybody but himself and this judge tries to ruin his career. That's right he knows that espn will fire him over this. So congrats keep hurting the people help. Im sure the judge thinks that there is plenty of upstanding black men ready to take his place. Jalen here is some advise move join everybody else. Oh an for all the people in here that are so negative on drunk driving. Hey moral police quit running around preaching when you crap around your own lives holding on to one thing you don't drink and drive. Big deal grow up!

The lawyer's outrage is ridiculous.

20 days for a DUI is very fair.
Who cares if he did all those great things -- it didn't stop him from driving drunk, now did it?

You can KILL someone while driving under the influence. 20 days is nothing.
