Amanda Knox

Released from Prison,

Murder Conviction OVERTURNED

10/3/2011 12:48 PM PDT BY TMZ STAFF

An Italian appeals court has overturned the murder conviction of Amanda Knox -- and the judge has ordered her to be released from custody.

Knox burst into tears -- and was immediately rushed out of the courtroom by armed police officers.

Knox's family plans to fly her out of Italy and back into the U.S. as soon as possible.

Cheers rang out inside the courtroom when the ruling was read. Outside the courthouse, the reaction was more mixed -- with people chanting, cheering and booing.

In 2009, Knox was convicted for the 2007 slaying of her former roommate Meredith Kercher. She was also found guilty of falsely accusing her former employer of the killing. But Knox appealed the verdict ... based, in part, on new information related to the DNA evidence in the case.

While the court overturned Knox's murder conviction, it UPHELD her conviction for falsely accusing her former employer of killing Kercher. Knox was sentenced to 3 years behind bars for that crime, but since she has already spent 4 years in custody, Amanda will not serve any additional time.

The court also overturned the murder conviction of Knox's ex-boyfriend Raffaele Sollecito -- who was also ordered to be released from custody.

Black Justice

So if Amanda and her boyfriend are clear what about the black guy that was with them and is currently doing time for the killing? Will he get released or is the brother still "guilty"?

People who are comparing this trial to Casey Anthony obviously have no clue about the trial. Someone else is already serving time for Meredith Kercher's murder and there was absolutely no evidence linking Amanda Knox to the the crime.

Thank God. This was an outrageous abuse of justice. RUDY GUEDE is the killer and he was the ONLY killer. It's about time this young woman was allowed to return home and leave that embarrassing court system. Enjoy your life Amanda ... and rest in peace Meredith, Rudy is where he belongs.

If anything, Knox, who, as part of the appeals process, has the right to a retrial next year, is fortunate to be a foreigner in an Italian jail. There she has learnt the language, entered short-story competitions and sung with nuns. Better her plight than that of a poor black outsider sent to a brutal, overcrowded American prison, or to the electric chair. Or of some foreigners – Knox's 26-year sentence is little more than a third of the 70 years that Gary McKinnon could face, simply for wanting to satisfy some curiosity about UFOs.

Knox was found guilty because of the inconsistencies in her defence, and because her DNA was found on the supposed murder weapon.Nor is the Italian criminal justice system inherently faulty. A mix of French inquisitorial procedures and Anglo-Saxon adversarial ones, this system does lead to lengthy trials, but they are independent and impartial.

I still think she was involved.... she's free because of a botched police investigation and not because she's innocent (imo). Just a huge coincidence that the 1 and only time during the time she was in Italy that she turned her phone off was the night of the murder.... I'd say she knew it could track her to the scene so turned it of. Purely cir****tantial but there is loads of these "cir****tancial" coincidences.
