will concede she violated her probation by getting kicked out of her community service program ...TMZ has learned.

Lindsay will appear in court on Wednesday ... where Judge Stephanie Sautner plans to hold a hearing on whether Lindsay violated her probation. But our sources say the hearing may be unnecessary, because Lindsay will not put up a fight.

Sources tell us Lindsay's strategy -- courtesy of Shawn Holley -- is to show the judge she is now really, really serious about complying with the terms of her probation. She'll come to court armed with proof she's logged in 24 hours of service at the morgue -- way more than the 16 hours a week the judge required before Wednesday's hearing. And Lindsay still has time to put in more time.

Lindsay's plan has its risks -- she faces well over a year in jail if the judge throws the book at her. We're told Lindsay is hoping for minimal jail time -- two weeks -- which would actually be way less because of overcrowding.

The wild card, of course, is Judge Sautner, who made it clear at the time of sentencing ... if Lindsay violated probation she would go to jail. Based on the judge's statements ... it's unlikely Lindsay would score a 2-week sentence.

TMZ is going the safe route this time....tired of egg on their face when the legal system lets her walk YET again. I don't know though....something might actually happen this time. If some jail DOES happen, it is because Michael Lohan's judge didn't take any ***** and came down hard on him. The California judge is under pressure now to be tough, because of course people will be comparing the two, and the CA judge knows it. So Michael, you might have actually helped your daughter just like you have always wanted to! LOL

I find it very, very hard to believe this. Why did it take so long for her to be 'really, really serious'? Did she have a serious talk with her mom? That is just too hard for me to believe.

Sometimes I wish one of the judges had temporarily stripped her from everything she has. Force her to find a regular job, create a special account for her salary, force her to rent an appartment, block her from accessing any other accounts she has, her condo and make her keep that job for at least one year. She has to pay every bill using whatever her salary is. Maybe, just maybe she would learn what real life is about. And what if she screws up? Put her in jail for at least one year.
Unfortunately this is just one of my dreams...........(sighing).

If Lindsay doesn't fight that she was in compliance with her CS and other probation orders then she must be covering for someone she talked into or paid in the probation office to give her glowing reports and if all those records of phone sessions have to be proved all she can do is ask for mercy.Jail should be her only mercy no matter how long not house arrest.

This is the biggest load of BS TMZ have posted. Who wrote this? an intern? you can't even get the number of CS hours right! Lindsay was ordered to do 16hrs a WEEK, not a total of 16hrs.


It shows TMZ once agin will make up any crap for hits. This complete story is absolute fabrication and pathetic.

I knew her and Holley would toss this "I did good for once in CS" crap up and hope it overrides everything else. She's hoping for TWO WEEKS? Ugggg, she's done that time before and came right back out with a worse disposition. I just can't wait until Wed. Probably to be livid again bur nevertheless.

First off I thought it was 16 hours per week = 32 hours total? Next - the judge is looking for *patterns* which would prove Lindsay's intent. Blowing off appointments for 6 months and then doing some emergency token days at the last minute is a trick she has pulled before and I doubt Stefani Sauntner will fall for it - remember, she has to deal with deadbeat druggies like Lindsay every day and knows all their tricks. Then there is the fact that she was almost 3/4 hour late for the first morgue session for no good reason other than she was curling her hair or some crap. This looks terrible, especially as she then tried to pull the cupcake bribe the next day. Also, the fact that she was doing a full frontal playboy spread during this time, while not a violation of probation simply will not leave a good impression with the judge.

Rumor are repeating a previous story, they didn't write it. It's not Lindsay Lohan. Some second rate photographer got a girl to pose on a bike and said it was LL. LOL anyone can see its not her.

Yeah Linds, get it girl. You logged in 24 whole hours for your community service in what? Three weeks? Hun, I logged in 52 hours at my job just last week. Your ass belongs in a cage for a while, but you'll get off. Judges in H'wood are star struck cowards.

Did we not hear this same "promise" after she was thrown in jail the last time? Lindsay does and says whatever she thinks she needs to do to get out of trouble at that moment. If she were serious at all she'd still be at the Women's Shelter doing as she was ordered to do!
I don't believe at this stage of the game anything is going to work for Lindsay. She's 24 and hasn't even started to take ownership of her problems. I don't think she ever will. Sadly her mother and father are idiots. They can thank themselves when we bury Lindsay at a young age. Then maybe they'll "get it".

In any other country it is the department of corrections which decide what community service program the convicted persons have to do their service in and if they feel that the society can benefit by transferring an individual to another program because the first one turns out to be a bad fit, they will do it in order to save time and money and to let as many convicts as possible finish their punishment.

The fact that this judge selected a special community program and didn't the department of corrections do their job could be a sign showing that there is something wrong.

What ties do the judge have with this woman center?

We are some who know what the Pennsylvania Kids-for-Cash scandal was about.

Why were she so set on the woman center and not Red Cross?

It should be investigated!!
