will concede she violated her probation by getting kicked out of her community service program ...TMZ has learned.

Lindsay will appear in court on Wednesday ... where Judge Stephanie Sautner plans to hold a hearing on whether Lindsay violated her probation. But our sources say the hearing may be unnecessary, because Lindsay will not put up a fight.

Sources tell us Lindsay's strategy -- courtesy of Shawn Holley -- is to show the judge she is now really, really serious about complying with the terms of her probation. She'll come to court armed with proof she's logged in 24 hours of service at the morgue -- way more than the 16 hours a week the judge required before Wednesday's hearing. And Lindsay still has time to put in more time.

Lindsay's plan has its risks -- she faces well over a year in jail if the judge throws the book at her. We're told Lindsay is hoping for minimal jail time -- two weeks -- which would actually be way less because of overcrowding.

The wild card, of course, is Judge Sautner, who made it clear at the time of sentencing ... if Lindsay violated probation she would go to jail. Based on the judge's statements ... it's unlikely Lindsay would score a 2-week sentence.

What I honestly can’t figure out is if she is getting special treatment or not, based on what happens to similar people in CA. We’re so liberal out here in MA that we pay large cash settlements to convicted felons for the psychological pain and suffering they endure from getting convicted in open court but we still actually do send people to jail and this woman would have done time by now, even here. It does appear though, that NO ONE goes to jail in CA unless they have inflicted serious bodily injury, and done so more than once. How much can this judge do to her in reality? If she does actual time does that end the probation? It almost seems that beating her with more and more hours of CS is all that the judge can do and is what will actually most inconvenience Ms. Lohan.

so what is it going to take for Lindsay to serve REAL TIME in jail? for her to kill someone? or would she still be able to make bail and be lt go because of "overcrowding" since she gets special treatment. Lindsay could be drunk as a skunk and high as a kite driving and run over and kill someone and Lindsay would probably blame the person she ran over instead of herself, she would probably say "well..it wasn't my fault, that person should have looked both ways before crossing the street, I didn't do anything wrong" blah blah blah, cause in Lindsays little world nothing is ever her fault. Why do they keep letting her make bail when they send her to jail? Do they really think that her being in jail for a couple hours is going to teach her a lesson? Do they really think that giving her chance after chance is going to teach her a lesson? They shouldn't be giving anyone special treatment and Lindsay doesn't deserve any kind of special treatment because she has the "I am better than everyone" attitude. She has proved to everyone that she is going to do what she wants, when she wants..unless a judge grows a pair and says "you are going to jail, no bail, no getting out early no matter how crowded it is" throw her in the snake pit already and don't let her have her "prescription medication" in jail either, who cares if she is "in pain" or has "anxiety" or "ADD"? if everyone else there has to suffer then so should she.

and extra 8 hours is nothing... especially considering she not only blew the community service off, she claimed she blew it off because "It was not fulfilling". She needs to do a lot more than an extra 8 hours to make up for that blunder.

her problem is, she repeats the same pattern. 'I'll take it seriously this time', 'no REALLY... THIS time I'll take it seriously.' 'Okay that last time was practice, but THIS time...'

I would say she needs a little jail to teach her a lesson, but I don't think it's a lesson she'll ever learn... so she should go to jail just because its what would happen to anyone else who breaks the law, then breaks the terms of their probation.

Seems to me that does this after she has violated her probation over and over again........She is playing this Judge Sautner, she is playing the court system, she is playing with mosts intelligence......Lindsay has had all the mercy from this court that any others wouldnt. Lindsay plays the manipulator and Judge Sautner always falls for it! We all know she will do no time....so why even bother with the filthy whore anymore!

Judge Sautner is just another clown in the California 1st Circus Celebrity Court, she'll talk smack [to try to throw folks off the scent] then she'll give her [MAYBE] a month, that stupid sheriff Baca [another clown] will claim there's an over population in the jail--and they'll give her an early release her [because after all-she a non-violent offender. That goofy judge Sautner might want to take a course from the Florida judge one the art and ethics of being an impartial judge[I know that's an oxymoron for a California judge, why be a judge if you're not going to cash in on the perks? Right Sautner?]

this is a question to all the idiot "Lindsay Fans" on here. Why are you a fan of her? What is so special about her? She hasn't been in any movies for quite awhile because she is a liability, she is a drug addict and alcoholic, a theif, a liar, a stuck up snob, Why would anyone be a fan of someone like that? The only thing I can think of is that Lindsay fans must be drug addicts themselves, Why don't you dumb Lindsay fans look up to someone that is worth looking up to? instead of a junkie, trashy wash out. I hope Lindsay breaks the law in a country like China or Russia, if that happens then "special treatment" will go right out the window and she will see what hard time in prison is really like.
