REJECTS $200k Settlement

in Airplane Propeller Accident

Lauren Scruggs -- the model who lost a hand and an eyeball
Lauren Scruggs -- the model who lost a hand and an eyeball when she was struck by an airplane propeller last year -- claims she shot down a $200k settlement offer from the plane's insurance company ... and now she's suing for much, much more.

Scruggs filed legal docs in Dallas, Texas ... claiming the insurance company "verbally offered" to pay her $200k for the Dec. 3, 2011 accident ... and they explained it's the MOST the insurance company can pay out to a "passenger."

But Scruggs is calling BS ... claiming she shouldn't be considered a "passenger" because "she was not in the aircraft or getting in or out of it at the time of the incident."

The 23-year-old model argues she had "completed her exit from the aircraft prior to the time of the incident and was physically located on the tarmac when the incident happened. Until struck by the propeller, she was not in physical contact with the aircraft after her exit."

Scruggs is asking for unspecified damages ... but we're guessing she wants WAY more than $200k.

Stupid AND GREEDY!!!!!

The dumb twit walked into the propeller all on her own. It makes noise and it blows air. She looked like a freak before her accident; her eyes gave me a creepy feeling! Reminded me of Robert Tilton's 3rd wife. YIKES!!!

Although I feel bad for her, SHE walked into the propeller after she had already exited and walked away from the plane and then SHE made the choice to go back and thank (also known as flirt) the pilot. They don't owe her anything. If anything, her insurance should pay but I don't think insurance companies pay out for stupidity.

Seriously I believe it's totally her fault and not the pilot's fault. It's called common sense you just don't walk near the propeller of a plane while it is in motion. She should be sued for being an idiot... Seriously what is this world coming to? I guess it all depends on who was negligent and how much his liability coverage is. He probably has 1 or 2mil in liability coverage. Texas is a contributory state which means both parties can be at fault. She will get some sort of payout, but not as much as if he were found 100% at fault. I think $200,000 is a slap in the face. Her med bills probably far exceed that. If protocol is for him to turn off his prop before passengers exit the plane, than he is at fault regardless of her inability to see the prop and accidently walking into it. But regardless, its a tragedy and I hope she can get back to her normal life, whatever that may be.

In Texas, the law of comparative negligence would be used at any trial. Both the pilot's and her responsibility would be considered by the jury. However, one important aspect is if she is found 51% or more negligent, she recovers nothing.

If I was on the jury, I would put the majority of negligence on her. There's no excuse for not watching out for a spinning propeller and walking in to it.

ALSO, this chick was NOT a model. Having your boyfriend take some pictures of you doesn't make you a "model!"

If not $200,000, how much is stupidity worth nowadays? Does it depend upon the situation? Stubbing her toe on an isle seat is worth $200,000 so being chopped up in a propeller has got to be worth a cool million, right? This is the type of country that we live in. Where lawyers are ambulance chasers and people do not get to pay for their own stupidity, but instead, they get paid for their own stupidity.

And I hope she get it too, damn she deserve every cent and then some. She lost a eye and a hand... that's more then $200k that won't even cover medical, suffering and pain, Insurance company is full of crap, try 2 hundred millions, you ********s!
