Bartender-Shoving Case

Cuba Gooding Jr.
is officially off the hook after allegedly shoving a female bartender in New Orleans this week -- the City Attorney has refused to file criminal charges.

According to the City Attorney's office, the case was dismissed due to a lack of a complaining witness -- i.e. the bartender in question, who announced yesterday she did NOT want to press charges.

The court signed an expungement order moments ago -- meaning it's like this whole thing never happened.

TMZ broke the story ... an arrest warrant was issued for Cuba on Tuesday -- when a female bartender at The Old Absinthe House on Bourbon Street said Cuba shoved her.

The bartender told police Cuba had gotten belligerent with other bar patrons for taking pictures of him -- and she asked him to leave. That's when she says Cuba roughed her up.

The argument then spilled outside, where Cuba called the bartender a "racist." We posted the video this morning.

But it's all water under the bridge now ... at least legally.

Good for him. TMZ never did post why the woman kicked him out out of the bar. You only said he got kicked out because he was angry. Did he yell at them? Did he curse? Anger alone is no reason to kick him out.

People are so RUDE they have no manners at all.

When I was a kid in Hollywood we were taught NEVER to approach celebs in a private place especially when they were eating or drinking...

I would have gotten slapped for asking Mr Gable for an autograph while dining at Muss & Franks.

A few weeks ago we were at Mels when a minor B-Celeb (Ron Jeremy) came in and I watched no less than a dozen people jump into his booth while a friend with a cell phone camera snapped pictures.

I have seen this idiotic behavior on the streets, in clubs, bars and eateries...

Does the public know they are dealing with fellow human beings who have a life?

I was not there in New Orleans but people need to know if you see a celeb in a public place just smile & wave...

Get in line outside with the Paps if you want an autograph...

I've completely lost respect for Cuba Gooding Jr. He got drunk in a bar, was obnoxious & overbearing to people & was asked to leave. He roughed up a bartender when asked to get out, and he has the gall to start yelling "racist" because he was kicked out?

Really bro; the race card? You've just cheapened every legitimate case of racism that's being prosecuted. Al sharpton apparently taught you well. So disappointed in you; you're pathetic...
