Allegedly Fled Accident Scene

6:00 AM PT -- Lindsay is telling friends she had no idea she hit anybody and it wasn't until she came out and got arrested that she knew anything was going on.

As for the story about one of the passengers in her SUV getting out of the car and checking for damages, she says it never happened. Nobody ever got out of the car.

Lohan is calling the incident "really fishy" because the man didn't appear to have any visible injuries and feels she's the victim of a set up. She's not going to let the incident go and is planning on fighting it to the end.

7:03 AM PT -- Surveillance video of the Lindsay accident appears to show her accuser was exaggerating.

9:10 AM PT -- Lindsay's accuser says she was "slurring" her words and reeked of booze.

was arrested for leaving the scene of an accident early this morning after allegedly clipping a pedestrian in downtown Manhattan ... TMZ has learned.

Law enforcement sources tell TMZ, Lindsay was pulling in to park her Porsche Cayenne near the Dream Hotel in downtown NYC when -- at a very low speed -- she allegedly hit the knee of a 30-something year old guy. That was around shortly after midnight.

We're told one of Lindsay's passengers in the SUV got out and checked the vehicle for damage, and then LiLo and co. went inside the hotel.

We're told someone called police while Lindsay was inside ... and when she walked out of the hotel -- around 2:30AM ET -- officers arrested her.

As Lindsay was taken into custody she frantically screamed, "Call my dad!  Call my dad!"

According to our sources ... Lindsay was taken to the station, fingerprinted, photographed and booked for leaving the scene of an accident -- a misdemeanor -- and then released with a desk appearance ticket ... meaning she did not have to pay bail before release.

We're told alcohol was not involved.

We're told the alleged victim was hospitalized ... however, he was not knocked down or dragged, and didn't have any visible injuries.

This arrest could absolutely trigger a probation violation in Lindsay's jewelry theft case because one of the conditions of probation is she OBEY ALL LAWS.

Even without a conviction, Judge Stephanie Sautner -- the judge in the jewelry theft case -- could haul Lindsay's butt into court if there's probable cause to believe she committed a crime.

Well so much for her mom's comment on Dr.Phil that most of the problems with the law wouldn't have happened if she had been in New York.
Lindsay is just one big Car Wreck waiting to happen - every time she gets behind the wheel.

I was just at Dream NYC which I am ahamed to say. My friend wanted to go. I personally hate these Chelsea hipster trendy hotels and most of the people in them. At 9 it gets too cool for school and a bouncer tells who can stay and who is cool enough to get in. To think if I went a few days latter I could have been run over by this coke head.

Bad enough we NYC folks have to worry about being killed by crazed taxi drives but now we must worry about Lindsay Lohan!

This doesn't make sense. She allegedly hit a guys knee, her passenger got out to check damage to car and they went inside? something weird going on. Sounds to me she had a minor fender bender, the guy saw what happened and reported to the cops she hit him, thats one way to try for a payout. I'm not buying this.

Come on...Everyone knows this girl can't drive and should not have a lisence to drive in any state or any other country..
This girl should not even be able to ride the Go KArts at DisneyWorld.
But i do not believe she purposly hit this person and if she was gonna flee the scene i would think she would of left in the car and not went into the hotel..I do not think she will be violiated but i do think she shoould have her lisence taken away.She is a accident waiting to happen.

I just read this about New York law:

n New York City, a desk appearance ticket (DAT) is an order to appear in Criminal Court for an arraignment. A person who receives a DAT has been arrested. The DAT is simply one of two alternative means by which a person who is arrested appears for arraignment, or first appearance. A person who receives a DAT is permitted to appear in court on his own on the date indicated on the DAT do***ent. A person who does not receive a DAT is processed through the arrest to arraignment system and is supposed to have her arraignment within 24 hours. From the point that the case is arraigned, a DAT case is like any other criminal case. DATs are usually only issued for misdemeanors in which there is little chance that the defendant will flee the jurisdiction; currently, DATs may be issued for violation, misdemeanors, and "E" felonies. If a person fails to return to court on the date indicated on the DAT, the Court will issue an arrest warrant.
