DROPS Restraining Order

Against Olivier Martinez

It's pretty remarkable, but a week after nuclear war at Halle Berry's house which left Gabriel Aubry's face a bloody mess, they have figured out a path to peace ... and the clearest evidence is that Gabriel's lawyer just went to court and dropped his restraining order against Olivier Martinez.

It happened just a few minutes ago. Shawn Holley, Gabriel's lawyer, told the judge her client no longer needed to keep Olivier away from him.

As TMZ first reported ... the parties struck an agreement Thursday to end their mega-dispute, which revolves around 4-year-old Nahla.

The remaining issue ... Olivier made a citizen's arrest after the fight and the case is going to the L.A. City Attorney for review.  We're told it's "highly unlikely" Gabriel will be prosecuted.

If Halle can do it, maybe there's hope for Middle East peace.

I think Halle and Olivier know that this has been an disaster for them publicity-wise. No doubt, her management team has been working overtime this past week trying to calm things down with Revlon and likely a studio or two to keep her working.

I'd like to think, though, that Halle just got the crap scared out of her with the fallout from this incident. I have no doubt in my mind that, but for the settlement, she'd be facing losing custody and access to Nahla. Whether Gabriel would be facing the same is up for debate, but he would be in a better position than Halle before a family court judge. Moreover, Halle may have gotten a verbal lashing from people around her about how she's been treating this situation and may have come around to realizing that a) Gabriel Aubry is not going to go away and forget his daughter, and that b) such a father was one she'd always wanted herself to have and never could, so driving him off would only repeat her own misery in Nahla's life.

I'd also like to think that the settlement was not primarily monetary: $20K a month is plenty for a young child and Gabriel's finances, at least, will keep him comfortable for some time. He may have received compensation to cover his medical bills and lost income, but that would be what he'd expect from a lawsuit anyway, without the legal fees.

We'll see how nice they play from now on. Whether Olivier stays with Halle after this when he couldn't be bothered to stick with Kylie during her bout with cancer remains to be seen.

Gabriel may have been the one beat up that terrible day. But those two did not anticipate the massive beat down THEY got in the forum of public opinion. And since that's how they make a living, oops! See, Halle, life is not a movie; you're not always the star that ends up with things going your way, and Olivier- you're not the big, bad heroe in the end that everyone falls in love with. At this point, Martinez- you look like an *******. And you Halle...thought I'd never say it: I actually have some sympathy for you. It is SO Very sad when someone becomes what you have- a middle aged woman who never grew up.

WHY? I hope gabriel dropped it on the condition that olivier has no contact with his daughter. this would mean that halle has to end the engagement and stop livng with olivier. halle you are wrong wrong wrong. you should have went to a sperm bank and not been in a relationship since you think nahla is yours and not you NAD GABRIEL' s daughter.

I think the only reason Halle/Olivier are even interested in settling this is because of the backlash. Makes me sick how tmz makes it sound like Halle is responsible for resolving the issues. Guess everyone was correct when they said tmz was bias. I am glad they are moving forward for Nahla's sake, just makes me ill when people act like this and never face a consequence.

ROL reported that Oliver is not allowed to anywhere near Gabriel when he drops off Nahla and Halle and Oliver are paying Gabriel's medical and legal bills which is the least they can do. I think Gabriel should have sued for lost wages since he is a model. Also I think Gabriel should have kept that restraining order since Oliver has proven that he is violent and has a horrible temper. After everything that they have done I would not trust that Oliver will keep that word and not go near Gabriel. I think he made a mistake dropping the restraining order. It's amazing that Gabriel was letting Halle have Nahla on Thanksgiving when the court ruled that was Gabriel's day to have her after everything they had done to him already! Yet Oliver still physically attacked him out of nowhere. I think Gabriel is too nice. There is no way Halle would have done the same for him if that were reversed. I hope from now on he won't do them anymore favors like that because they clearly don't deserve it or appreciate it. Charges will probably not be filed against Gabriel but if they are, he should file a police report against Oliver and press charges.

Gabriel should bring a bodyguard with him next time if he has to go to that house again. I think a nanny should pick up Nahla from Gabriel's house and bring her to Gabriel also and Halle and Oliver should not be there. There is no reason he should ever have to go back to their house again and it is mistake to do so with this much anger among them.

So if you watch an interview that Halle did with Oprah when she was about 4 months pregnant.The word she uses overand over describing Gabriel is integrity .
And gentle soul.

Gabriel, like any decent father, wanted what was best for his daughter, and decided that she would be happiest if brought her to her mom's house for Thanksgiving. Halle set him up.

It wasn't Halle that took the child into the house, it was a servant. It was a set up. The push-shove ensued, just as it had with the nanny, but this time, the trained fighter was on the receiving end.

Supposedly, the child was already gone.

Matched force is the key here. If you are shoved, you cannot shoot or bring on the hate. If you are shoved on the subway, you are not entitled to bring on the "I'm going to obliterate your face and pound your head into concrete assault that could leave you dead lethal force," which is what happened here.

The rest of the world watchs in disbelief as Oscar winner Halle sets up Gabriel to be brutally assaulted in front of her child by a trained boxer, and the LA PD has no problem.

You don't need to hear the English translation to understand that Olivier was intent on Killing Gabriel. Look at the pictures.

Matched force. That does hold legal relevalence.

Olivier was a monster. Gabriel is not a wimp for being afraid. He is dealing with a sociopath and her henchman.

What is up with LAPD. What is up with Halle Berry? She is maniacal. She will never play in a film again unless it is as the woman cooking the bunny while her daughter watches.

Gabriel . . . sit back . . . Halle has jumped the shark . . .it may take a little time, but just wait . . . .her craziness has not yet peaked.

For your daughter's sake, you really need to be well grounded when it does.

I wonder what went down for Halle and Oliver to suddenly decide to play nice? If they were in the right there is NO WAY she would give in on anything. Gabriel seems like a decent guy who just wants to be able to have close relationship with his little girl.
