Instagram is in full damage control mode ... with company's co-founder firing off an emergency statement SWEARING the company has no plans to sell its user's photos.

The statement is a desperate attempt to quell concerns after the company released a new terms of service agreement to users yesterday which says "a business or other entity may pay us to display your username, likeness, photos (along with any associated metadata), and/or actions you take, in connection with paid or sponsored content or promotions, without any compensation to you."

After several famous and non-famous users vowed to stop using Instagram, co-founder Kevin Systrom released a statement saying, "It is our mistake that this language is confusing. To be clear: it is not our intention to sell your photos."

Systrom continues, "[The new terms of service] was interpreted by many that we were going to sell your photos to others without any compensation. This is not true."

He adds, "Instagram users own their content and Instagram does not claim any ownership rights over your photos. Nothing about this has changed. We respect that there are creative artists and hobbyists alike that pour their heart into creating beautiful photos, and we respect that your photos are your photos. Period."

"I always want you to feel comfortable sharing your photos on Instagram and we will always work hard to foster and respect our community and go out of our way to support its rights."

Systrom says more updates will be coming soon.

Too Late, the damage is done. First off, i do not use Instagram but as a photographer, telling me that your not going to sell my photos but you can use them without compensation is just a slap in the face. They may not sell our photos but they are going to use our photos as advertising to promote their company. It doesn't matter how you word it they still want to use something they did not pay for to make a profit.

So, what he's saying is they totally intended to invade for privacy but they will not violate your exclusive rights to display your works of original authorship fixed in some tangible medium of expression. as with facebook, selling ad space is a good way to undercut/undermine spam posts. if they didn't have all the ads, i'm sure people would be more likely to post massive spam of pages.

I deleted my account yesterday. There are plenty of other photo filtering apps for my pictures that I can use. I don't trust that the ppl at instagram won't find someway to give out the my pictures to ppl for some kind of compensation. BAM

If you aren't "planning to" then why change the TOS? So that you STILL CAN and a lot of people wouldn't even know it! Your backtracking isn't good enough. If you don't "plan to" then change the TOS back. No need to have it in there right? I won't be going on Instagram either way but to me, it's the only way you can fix the mess.
