7:30AM PST:
Justin released a statement, saying ... "Hopefully this tragedy will finally inspire meaningful legislation and whatever other necessary steps to protect the lives and safety of celebrities, police officers, innocent public bystanders, and the photographers themselves."

8:40PM PST
Justin Bieber was not in the Ferrari ... sources familiar with the situation tell TMZ.  We're told one of Justin's friends was driving and another friend was in the passenger seat.

A paparazzo attempting to shoot photos of Justin Bieber's Ferrari was hit by another car and killed this evening -- although Bieber was NOT behind the wheel of the Ferrari ... TMZ has learned.

Law enforcement sources tell TMZ Bieber's white Ferrari was pulled over by California Highway Patrol for speeding on the 405 ... near the Getty Center in LA.   The CHP directed the driver to pull off the freeway, onto Sepulveda Blvd.

According to our sources, Bieber was DEFINITELY not driving at the time.

We're told a paparazzo -- who was following the Ferrari at the time of the pull over -- attempted to snap pics while officers conducted the traffic stop.

The photog then crossed Sepulveda to snap pics and was told twice by the CHP to go back to his car on the other side of the road.  When the photog tried crossing back, he was struck by an oncoming vehicle as he crossed back and was killed.

Our sources say drugs and alcohol were not a factor for the driver of the vehicle that hit the photog.

LAPD is now on scene investigating the incident.

I think everyone really misses one point here, it was terrible for the photograper who was killed & his family of course, but, by obeying the police's orders to go back to his car (he should have looked both ways)! But, it is Da Beiver's fault, basically, by, letting a 19 year old "rapper" friend "Little Twister" drive his car, worth over 100k & he got a ticket for speeding too! But, if, the kid (little twister) had of got in an accident, killed or maimed someone, it would have been Da Beiver who was on the hook for untold millions, as the car was registered to him, Da Beiver.

Someone had better put some reins on his friends and who Beveir hangs with, or, restrictions on who drives his cars from now on? Just a thought. Look for a lawsuit by the relatives of the Photograher and look at the chain of events too, it may be meritted?.

Get over it, just cause it was his car doesn't mean it was his fault, the pap should've listened.

Sorry to hear about your fellow photographer. I think it was just an accident. I do know though that when I am driving I am alert and I slow down if people are standing on or near the road. Obama has the solution though: ban cars!

Two contributing factors in this death: First, if the photographer had not been told by law enforcement to return to his car he might have used better judgement in crossing the road. Second, If the CHP had not found it necessary to pull over the Ferrari (was it going so fast as to be be really dangerous?) the hazard of a traffic stop on the 405 would not have happened. Stopped vehicles are often more hazardous than crime of speeding.
