0227-lindsay-lohan-no-dealLindsay Lohan did NOT cut a plea bargain Wednesday with prosecutors in her lying-to-cops case ...TMZ has learned ... and right now it looks like she's headed for trial.

We broke the story ... Santa Monica and L.A. City prosecutors had a noon meeting via telephone with Lindsay's lawyer, Mark Heller

Sources connected with Lindsay tell TMZ ... prosecutors insisted Lindsay accept a significant amount of time in a residential rehab facility, but Heller wasn't having it.  We're told prosecutors bent a little and offered somewhere around 30 days rather than the 60 they initially wanted -- still Heller didn't accept.

We're told Heller and prosecutors have not given up, and one source connected with the talks tells TMZ, "Negotiations are ongoing."

BUT ... sources say Heller and Lindsay are not in lockstep -- he's willing to accept a plea that involves counseling and possibly some sort of rehab, but Lindsay says she's not accepting any of it because to her it sounds like "punishment for something I didn't do."

Bottom line ... prosecutors aren't worried if they can't strike a deal -- we're told they're more than willing to go to trial March 18.

Lindsay Lohan: L.A. prosecutors want 90 days in rehab, source says

Lindsay Lohan will have to agree to serve at least 90 days in a lockdown rehabilitation facility if she wants to avoid trial on a charge of lying to police about being behind the wheel during a crash on Pacific Coast Highway and violated her probation for shoplifting.

While Santa Monica city prosecutor Terry White and Lohan attorney Mark Heller have discussed a possible plea deal, the L.A. city attorney, which secured a jewelry theft conviction against the actress, won't accept any deal of less than 90 days in a locked rehab center, said a source familiar with the prosecution.

In the event Santa Monica's prosecutor agrees to a lesser sentence, L.A. prosecutors will probably object and ask that Lohan be sentenced to 90 days for violating the terms of her probation, the source said.

The negotiations Wednesday were snagged by the issues of Lohan's entering rehab, community service and extensive therapy to resolve the misdemeanor criminal charge, according to several sources. If no deal is struck, prosecutors will go to trial next month.

According to sources, L.A. prosecutors are taking a hard line because Lohan has a history of repeatedly disobeying court orders, and those involved believe she needs "meaningful rehab" in a credible facility.

They don't want to send her to jail, but without meaningful treatment "she is not only a danger to herself but to the public, especially while driving," according to one source familiar with the prosecution.

C'mon guys, Lohan has no problem with rehab as long as she can go out for 10pm-1am happy hour. See no problem.

Of course rehab is a joke to Lohan. She doesn't want rehab and sure as hell she doesn't want to have to pay for it. Just like the shrink.

If she goes to jail it's on the state. Anything outside of jail is on her dime.

Heller wants to resolve the case with an agreement Lohan will commit to intensive psychotherapy and perform community enrichment activities such as public service announcements and motivational speaking.

"She's an iconic individual who would make an outstanding role model in her new persona," he said, referring to his claim Lohan has experienced an epiphany and now is committed to "fixing" her problems. "People are attracted to her and interested in her life. I want her in a position where she can help others."

TMZ Live was, meh. I really don't hearing Ryan talk about Lohan but he is even spot on when (and Mike agreed) that she has a ton of "yes" people around her telling her she won't do jail time, "I can get you off." Shawn would never take it to trial, because she has a very weak case. But as everyone as said on here, even if she did the rehab she doesn't want it and would only do it to please the courts. Not looking good for her, really in any aspect of her life right now. He did say she's going to be in court tomorrow but I think he screwed up there. She won't be unless she has to.

Harvey just said that Lohan won't take the deal and made it sound like Lohan will be in court tomorrow. Yet said nothing about streamlining live. So who knows.
