TMZ has learned ... Charlie Sheen is not formally checking into his rehab facility today to fulfill his 30-day jail sentence ... because, in effect, he's been completing the terms of that sentence for weeks.

TMZ broke the story ... Charlie plea bargained his domestic violence case in Aspen earlier this month ... and agreed to a 30-day jail sentence. But under the terms, engineered by attorney Yale Galanter, Promises rehab facility in Malibu is responsible for administering the sentence -- in other words, the time served is at Promises and not in jail.
We've learned ... although the plan was for Charlie to formally check into Promises today for his sentence, that's not going to happen. We're told the way Promises sees it ... Charlie has been getting aftercare for months, sometimes even sleeping at the facility.
There will be no formal check-in. As one source says, "It's an ongoing process for Charlie." We're told when the case is back in court in November, Charlie will be able to show he's completed the 30-day sentence many times over.

The singer from Train claims he's happy Charlie Sheen and his daughter could bond over their hit "Drops of Jupiter" -- even though Sheen told cops the song played a role in the Christmas Day domestic dispute with his wife.

pretty sure that Drops of Jupiter is a positive part of Charlie Sheen
and his daughter's relationship. Just gonna look at it that way."
As we previously reported, Charlie told cops that Brooke got jealous and violent when she found out he and his daughter had a special song -- "Drops of Jupiter." Brooke's mom called the story, "Silly."

Charlie Sheen's estranged wife Brooke Mueller returned to the spotlight for a dinner date at XIV with her mom in Hollywood last night ... but when asked about the alleged altercation with Charlie, she got right off the Train tracks.

One day after Aspen police released the report from the Christmas Day incident -- in which Charlie told a cop that his fight with Brooke started over the Train song "Drops of Jupiter" -- Brooke was deflecting like crazy, pretending she had no idea what the photogs were talking about.
Brooke's mom, on the other hand, called the Train story, "Silly."
Brooke did answer questions about her kids ... and herself ... telling photogs that she's still a "happy camper."

Charlie Sheen has another thing in common with your average college frat boy -- dude kept a fake ID in his wallet ... one that he claims was made for him "on the set" of one of his projects, this according to a police report just obtained by TMZ.

In the docs, filed by the cop who arrested Sheen after the Christmas Day incident with his wife Brooke Mueller in 2009, it says Sheen was ordered to hand over his ID.
But the officer explains -- in the report -- that when Sheen handed over the California driver's license, Sheen told the cop, "It's fake, I had it made from someone on the set after I lost the real one."
The cop says he then "confiscated the license."
It's a state crime to possess a fake California ID -- though it's unclear why Sheen wasn't charged for the alleged infraction.

Charlie Sheen claims the infamous Christmas Day incident with his wife Brooke Mueller all started after she learned that Charlie and one of his daughters shared "an affinity" for a song by the band Train, this according to new legal documents obtained by TMZ.

The Aspen Police Department just released the full police report from the incident, in which the arresting officer states that Charlie explained what happened before the alleged assault.
In the report the officer states, "[Sheen] ... explained that he and the daughter share an affinity for both astronomy and the song 'Drops of Jupiter' from the band 'Train.'"
"[Sheen] added that he bought two tracking telescopes; one for his daughter and one for him so they could both look at the same point in the universe at the same time, as a way of staying connected."
According to the report, Sheen told the officer that "Mueller was jealous of this relationship with his daughter. He stated that Mueller said, 'you have a song with you share with your daughter, but not one with me?'"
Sheen told the cops the argument escalated and they eventually started to "slap" at "each others hands or wrists."
Sheen was eventually arrested for 2nd degree assault, menacing, criminal mischief and domestic violence.

The only thing worse than losing your wallet is losing it, canceling all your credit cards, and then finding it -- as Charlie Sheen's soon-to-be ex Brooke Mueller can tell you.

Sources close to Mueller tell TMZ she lost her wallet about a week ago and took the aforementioned precautions. But lo and behold, a week later the wallet turned up ... at LAPD Hollywood division.
There was one small silver lining -- Mueller learned her wallet was found right before she was about to go to the DMV and get a new license.
And no one should have to go the DMV when they don't have to.

Sources connected with Charlie Sheen and Brooke Mueller tell TMZ now that Charlie's criminal case in Aspen is over, the deck has been cleared to begin divorce proceedings.

As we first reported back in June, Charlie and Brooke have signed divorce docs spelling out who gets what when their marriage ends.
Sources say they were holding off until Charlie's Aspen assault case was over, fearing a divorce would give prosecutors ammo in the case.
We're told almost from the beginning, Brooke has always wanted nothing to do with the case. And now that the case is over, we're told divorce docs will soon follow.

TMZ has learned Charlie Sheen's actual "jail" sentence will last only seconds.

TMZ broke the story ... under the plea deal just approved by the court, Charlie will get a 30-day sentence which will be "administered and executed" at Promises rehab facility in Malibu -- where Charlie stayed either full or part-time for more than a month earlier this year.
Sources connected with the case tell TMZ that Charlie will receive credit for "time served" ... translation, we're told Charlie will check into Promises on August 23 and immediately leave.
And it gets even better for Sheen -- he's already completed his 36 hours of anger management, another element of the plea deal.
The plea bargain is a victory for Yale Galanter, who shockingly represents the alleged victim in the case -- Brooke Mueller. Galanter ended up negotiating the plea with the Pitkin County DA.

Sources connected with the Charlie Sheen case tell TMZ Charlie has gotten the sweetest plea bargain ever -- he's been sentenced to 30 days in Malibu!

Sources tell TMZ, under the terms of the deal, Charlie will receive a 30-day jail sentence, but he will not spend one second behind bars. Instead, the sentence will be "administered and executed at Promises" -- the famous rehab facility to the stars. It's the same facility that Charlie spent weeks at earlier this year following his arrest.
We've learned Charlie will plead guilty to misdemeanor assault. The felony charge will be dropped. Charlie will be placed on three months unsupervised probation.
As we first reported, the sentence will in no way impede the production of "Two and a Half Men." After he enters his plea today, Charlie will fly back to L.A. at 5:00 PM and will be on the set tomorrow.
UPDATE 3:15 PM PT: On his way into court just moments ago, Charlie said he was feeling "great."
UPDATE 3:45 PM PT: Sheen has entered his guilty plea and the plea deal, as we reported, was accepted by the judge.

Charlie Sheen's plea deal is on the verge of being completed -- and not a second too soon as he's due back in court in Aspen, CO this afternoon.

TMZ has learned the final details are still being hammered out, but we know this -- the deal will not prevent Charlie from taping a single episode of "Two and a Half Men." Law enforcement sources tell us if Charlie does jail time it won't interfere with shooting of the show.
Charlie was charged with three crimes -- felony menacing, misdemeanor 3rd degree assault and misdemeanor criminal mischief -- stemming from the alleged Christmas Day altercation with his wife, Brooke Mueller.
Charlie's scheduled to be in court at 3:00PM PDT ... and TMZ will be live in Aspen.
