Prosecutor in Kiefer Case -- A Slammer Jammer

TMZ has obtained the sentencing recommendations in the Kiefer Sutherland DUI case.

The sentence is complicated, but Kiefer will do 48 days in custody.

Kiefer will do 18 days for the probation violation, surrendering December 21. He will serve an additional 30 days for the current DUI and must complete that sentence by July 1.

Based on what TMZ knows about production schedules, that would mean Kiefer is serving the bulk of his sentence when "24" is on Christmas holiday and not in production -- he may have agreed to the speedy disposition of the case in order to protect the show from having to shut down production.

Kiefer's lawyer, Blair Berk, would not comment on the case.

UPDATE: A rep for Twentieth Century Fox and the FOX Broadcasting Group issued this statement: "Today our friend Kiefer Sutherland resolved his criminal case at the earliest opportunity. Kiefer made clear to us at the time of his arrest that his first concern was the welfare of those he worked with and that he intended to do whatever was necessary to prevent shutting down the show because of his situation. He told us that even if he had to sacrifice more time in custody in order to protect the show and the jobs of those who work with him, he would do so. From what occurred today, it is evident he is a man of his word. We wish him well and look forward to a long relationship with him."

Why are all these millionaires alcoholics with not enough sense to drive when they are drunk. He needs different sexual organs in order to get a better sentencing. Look at Paris, Lindsey, Britney, and all the rest of the alcoholic, druggies in Hollywood.

People make mistakes, always. Kiefer is not a perfect person, he doesn`t think always in work things....what is the problem? He made a stupid mistake, he will pay because his mistakes. I don`t see pathetic things in this case anymore. Simply....he made a mistake, he try to preserve jobs in 24 Staff, he will be to jail some days. I have not doubt about he cares about his coworkers. What is the problem here?

Everybody drink, some people made mistakes about excessive Drink. Kiefer seems to have some problems with drinks. It`s his problem, no people`s problem. If every people which drink is a criminal, half of the world deserves jail. Not only Kiefer Sutherland.

He's more worried about the production of the show and the people he works with than about the people he could have injured or killed while drunk driving.. Just another intoxicated Hollywood idiot, and the courts just keep on coddling these people!!!.. If it were anyone else out in the 'real' world, the judge wouldn't have worked their sentence around their days off and vacation time... It would have been 48days...starting now. Get to jail! Grrrrrrrrrrrrrrrrrrrrrrrrr!!

You people who are bashing him about this are not looking at the bigger picture.
Sutherland is a respected, award winning actor and producer. He has had a well established career in the entertainment industry for many years and has done some excellent work in his time.

Sure, he was stupid to drive after drinking, but it is no worse than the stuff the other "celebrities" have been nailed for lately. Lohan has as many DUIs in a matter of a few months! That celebuspawn Richie admitted to being on vicodin and high on grass when she got busted and the skinny bitch only spent 20 minutes in jail (must be helpful to get some loser to knock you up to avoid jail eh Nicole?)

Kiefer is a stand-up guy who has a problem with drinking. He's admitted to the whole thing and is willing and ready to serve his time, AND to do it in a way that he doesn't jeopordize the well-being of the cast and crew of one of the biggest TV shows around.

Everyone who's posting stuff like "Boycott 24" and "I hope Kiefer gets ass-raped in jail" need to get their heads out of their asses and look at the larger picture. Is anyone really in a position to be playing holier than thou with this?

In the end, Kiefer will serve his time without the dramatics that we have seen over the summer with the useless Parisite and her twig thin bff or the coke monkey Blo-han. Hats off to him for actually taking a stand and considering the well-being of his co-workers and friends on set.

First i would like to say that i think he's being cool about the whole thing. he knows that he was wrong and he's willing to do his time. he's more worried about the people that he works with then himself which is very big of him. second, everyone makes mistakes and just because he's an actor it gets spotlighted more, i'm sure that some of you leaving comments on here have gotten busted for dui. some celebs do one day he's willing to do his 48 days total time, that he has til July 1st to complete. that means that he could do 2 days at a time from now till then as long as he does all 48 before July.

unfortunately most celebs get off easy and don't do the time that they should for the things that they do. star treatment is so unjust to the law, but that's how are crazy little world works. at least there are some decent stars like kiefer who know they were wrong and will do their full sentence, not look for a way out and only do a couple days instead. so don't be so hard on the guy. he made a mistake, he's human after all, it's just a part of who we are.

Blondie - I think it has to do with the fact that were he to serve his sentence in the middle of shooting it would put a few hundred people out of a job. I have no problem with them waiting off for that reason.

48 days ?? What court is he in? Must be the same court as Paris, Nicole and Lindsay. Someone needs to tell these Judges that DWI is not "cute and funny ". It's an unlawful act that disregards the safety of not only the driver but everyone on the road with him!

I was a victim of an asult in Fl...by the person was given 365 days. Even before he went to jail it was reduced for "good behavior, gain time, and pre sentencing evaluation" to 162 days. He did 59 days. It was a very violent case. It's not only California.

He's a grown man & he definitely knows better but I still love Kiefer & 24. He has to clean up his act because he could have killed someone & I hope he finally gets the help he needs. I am sad he's going to jail but it might be good for him. I do wish him luck & happy he took his punishment like a man & didn't whine about it.
