TMZ has learned the L.A. District Attorney is charging Mischa Barton with four misdemeanor counts: driving under the influence, driving with a blood alcohol level of .08% or higher, driving without a license and possession of marijuana (under an ounce) -- all stemming from her December 27 arrest.
The former "O.C." star was pulled over in West Hollywood, Calif. last year. Cops said she "was seen straddling two lanes of traffic and failed to signal when making a turn." When deputies pulled her over, they determined that she "was an unlicensed driver and was driving while under the influence of an alcoholic beverage."
Her next court date is February 28.

Better to learn this lesson now, or she could end up as screwed up and drugged out as you are at your age. She is young enough to overcome this. You people that criticize are not. Glass houses.
i FEEL THAT THE hOLLOYWOOD SET IS OUT OF CONTROL;. HOWEVER, WHEN IT COMES TO JUSTICE_ THEY RECEIVE A SLAP ON ThEIR HANDS! THE REAL CITIZENS OF CA. get the book thrown at them. They pat hefty fines, lose their driving licsences for monthes, and have to attend DIU classes.
BEING "UNLICENCED" NEGATES INSURANCE COVERAGE AND THE OWNER OF THE PLATES ON THE FRONT, AND BACK OF THE CAR ARE LIABLE FOR ANY INJURY OR DEATH SHE COULD HAVE CAUSED, EVEN IF SHE OWNS THE CAR ITSELF.........

I agree with the courts. and number 16 on this page..... she really needs to "change her playgrounds and playmates" so she doesn't end up like some of the other celebraties. She is so young and has her whole life ahead of her, hopefully this will make her think before she even thinks about doing that again......

there is one thing you can do and that is GET A LICENSE you've been in the States long enough to where there is no excuse.
This arrest is the only way she can get back into the public eye. She has no TV show, no movie, no talent. Why can't she accept her fate and quietly fade into obscurity where she belongs?
