Shia Won't Be Charged, License Will Be Yanked

TMZ has learned Shia LaBeouf will not be charged with Driving Under the Influence. The L.A. County D.A. just rejected the case on grounds of insufficient evidence.

LaBeouf was arrested after his car accident on July 27.

He is not off scot-free. Shia will almost certainly have his license suspended because he refused to submit to a blood alcohol test. Steve Whitmore from the L.A. County Sheriff's Dept tells us Shia's DMV hearing is tomorrow.

7. Doesn't the California justice system require that he spend a minimum of 15 minutes in jail. This little creep is lucky he wasn't dring in Texas !

8. Unless you absolutely know you are well below the .08 limit never consent to a test. Losing your license for test refusal is not an alcohol related event. No hassle with your insurance. Usually there are some hoops you have to jump through that will get you your license back far faster than from a DUI. Last point, it is cut and dried, you don't need much if any lawyer time.

13. "DMV hearing" my ASS!!!!.....when i refused the test after be suspected of DUI, the 1 year suspension was automatic per california law......more special treatment for celebs in LA!!!!!

15. LaBeouf was arrested July 27 after an early morning crash that injured his hand and sent him to a hospital for several days. Sheriff's deputies said later that LaBeouf was not at fault in the accident, which occurred in West Hollywood. LaBeouf's representatives had no comment Thursday. Shia LaBeouf won't face a drunken driving charge for his involvement in a July crash that left his hand mangled. Los Angeles County District Attorney spokeswoman Jane Robison said Thursday there was "insufficient evidence" to charge LaBeouf with drunken driving.
