Shia Won't Be Charged, License Will Be Yanked

TMZ has learned Shia LaBeouf will not be charged with Driving Under the Influence. The L.A. County D.A. just rejected the case on grounds of insufficient evidence.

LaBeouf was arrested after his car accident on July 27.

He is not off scot-free. Shia will almost certainly have his license suspended because he refused to submit to a blood alcohol test. Steve Whitmore from the L.A. County Sheriff's Dept tells us Shia's DMV hearing is tomorrow.

Unless you absolutely know you are well below the .08 limit never consent to a test. Losing your license for test refusal is not an alcohol related event. No hassle with your insurance. Usually there are some hoops you have to jump through that will get you your license back far faster than from a DUI. Last point, it is cut and dried, you don't need much if any lawyer time.
