McDonald's Sued

Over Woman's Naked Buns

McDonald's is known for its cheap meat -- but after a bad trip to the burger joint, one guy's wife allegedly became cheap meat.

McD's just got served by a guy who allegedly left his cell phone -- which contained nude photos of his wife -- at the Arkansas restaurant, only to find the nude pics posted online.

Phillip Sherman was assured by employees they'd keep the phone safe, yet the photos -- along with Sherman's phone number and address -- somehow found their way onto the Internet.

The couple claims they had to move to a new house to get away from his wife's new stalkers. Sherman wants 3 mil for their troubles.

If you are stupid enough to have naked pictures of yourself on ANY device that may be lost/stolen so easily (read - cell phone, laptop, etc...), then your dumb ass deserves whatever you get! This jerk is an idiot who more than likely is just trying to scam the corporation out of money.

This is actually a good case. It falls under the intentional tort of conversion. The employee basically converted this guy's personal property when he posted the pics. Intentional torts, like conversion, have punitive remedies available when proven. Further, the burden is not too stiff at only a preponderance of the evidence. So if the plaintiff proves to 50.000001% then the plaintiff wins. Also, respondeat superior is a doctrine that an employer is responsible for an employee while the employee is working. Therefore, McD's could definitely be on the hook for this one. If they are smart they will settle quickly and get this out of the news for a cheap price.

If this was a SCAM its for the police to figure out, not us. IF this is in fact legitimate, then these people deserve to be compensated. If this man chose to take pics of his wife naked, that was his personal right to do so. All you need to stop judging what people do in the privacy of their own home. It is his personal property after all, would you say the same if someone broke into their house and stole them off their camcorder or personal computer??? Think about it.

99.99% his fault for not passwording his phone. I'd say a Big Mac is plenty of compensation for the other 0.01% fault for McD. Of course, he'll have to give a third of his Big Mac to his lawyer.

You guys crack me up, if you had read the article you would know that he would have easily found the photos online because his phone number and address were posted with it. Yeah go ahead and search for the pics yourself but unless you know his info you'll find "nothing".
Another thing obviously everyone here who has left a comment, has never misplaced a single personal item in there life... and if you did, you made sure that you cleaned or removed any private information before you misplaced it.
I admit, he shouldn't have had those kind of photos on his phone anyway but I guess we all want laws to tell us what we can and can have on our phone... yeah that would be great!!
And 3 mill, yeah to much but moving expenses sure and maybe a grand or two... that I could care less about.
Oh and as a side note, I think the employees should have to post naked pics of themselves and there address and number just as a lesson... they would probably enjoy it though.
