Letterman Suspect Wants Charges Dismissed

David Letterman's accused extortionist, Robert Halderman, is asking the judge to dismiss the extortion case against him.

In papers filed with the court, Halderman's lawyer wrote, "The sensationalism surrounding this indictment, fueled by the celebrity of the purported victim and the deference paid to that celebrity by the District Attorney's Office, has swallowed the only pertinent issue ...."

The issue: Whether the grand jury had sufficient facts to support the extortion case.

The lawyer, Gerald Shargel, also states Halderman "discovered evidence that Letterman had created and fostered an environment of workplace sexual misconduct that under any definition, amounted to actionable sexual harassment."

The lawyer says this was not extortion, calling it "a pure commercial transaction." The lawyer says Halderman was merely trying to sell the exclusive screenplay rights to Letterman.

The lawyer says Halderman even insisted on getting a written agreement -- something extortionists generally don't do.

In addition to the motion for dismissal, Halderman's lawyer is asking to inspect the grand jury minutes. And, he wants the items seized from Halderman to be suppressed as evidence.

And there's this ... Attorney Shargel claims the relationship between Letterman and Stephanie Birkitt continued through at least last summer.

Anyone who thinks that Halderman will be convicted of extortion has their head up their butt. Once they start digging up the dirt on Letterman he will fold like a deck of cards. This will probably not even go to trial. Trust me folks you have not even begun to see what Letterman is hiding about his strange sexual appetites. Letterman will have to take the stand and they will rip him to shreds. I can't wait for the circus to begin and Court TV to take over. You go Nancy Grace!

Who the heck cares when the affair ended! Shame on TMZ for giving this extortionist more air time. What Letterman did or not do with Stephanie and when is between him and Regina. But extorting the last time I looked is illegal-PERIOD! Stop promoting this extortionist! He is NUTS obviously and his lawyer is even nuttier.

WTF???!!!......the guy blackmails Letterman, takes the check and deposits it in the bank.......they catch him red handed and he pleads NOT GUILTY.

Now the Grand Jury is determining whether or not they have enough evidence??? What's wrong with this country???

Re: #26: Certainly Halderman has been charged with extortion, and appears to be guilty...a jury will hopefully convict him and send him off to prison to consider his rather ill-conceived choices. As to Letterman, the only thing he appears to be "guilty" of may be infidelity...and we still don't know (and it is really none of the public's business) whether that extends to adultery (recent reports of his affair's continuance during his recent marriage are unconfirmed...and have only been claimed by Attorney Shargel, Halderman's mouthpiece, who has a vested interest in sullying Letterman's reputation) which is NOT an illegality with reference to criminal law.

This isn't a morality play, and there is no "tie". Letterman made a public apology to his wife with regard to his affairs, whatever else occurs between them is a private matter. He has no crime to compensate for in a court of law. Halderman committed a crime, extortion, has hired a legal mouthpiece in an attempt to justify or spin his actions, has no accountability, and will have to face a jury, and face the consequences of his actions per the legal system. As to the "chicks" being the "losers"...those "chicks" would be women, and none have protested, complained, or presented themselves as such. Referring to women in such a demeaning manner gives your own contempt for them away.
