Lindsay's Lawyer -- The Judge Is TMZ Free

Lindsay Lohan's lawyer told TMZ not to flatter itself by thinking Judge Marsha Revel would consider the now-famous photo we posted of Lindsay partying in France.

Lindsay's lawyer, Shawn Chapman Holley tells TMZ, "I do not believe that Judge Revel reads TMZ or any other 'celebrity' news and she would never be influenced by something which is NOT evidence in the case."

As we first reported, the D.A.'s office will not address the photo in open court because it's pure speculation that the substance on the table may or may not be cocaine.

But Holley wasn't done. She added, "It is difficult for Lindsay to get a fair shake because her every move is chronicled by TMZ and others. This creates an unavoidable frenzy around her case and subjects her to a level of scrutiny which non-celebrities do not have to face."

Oh yeah, one more thing -- Holley scoffed at Michael Lohan's lawyer, Lisa Bloom, for "taking credit for Judge Revel's decision" on Thursday. Holley says when the judge read Bloom's letter to her and the prosecutor in chambers on Tuesday, the judge cast it aside -- along with all the other letters from people not associated with the case.

Bloom fired back to TMZ, "Court staff told me the judge opened our letter in the presence of counsel and considered it." Bloom added, "No one asked for stricter controls on Lindsay besides us. The judge ordered stricter controls, including drug testing, which we specifically requested."

@Professor Obvious "79. The picture may not be admitted as evidence but it certainly is prejudicial and will not make the judge's opinion of Lindsay improve."

lol, just contradict yourself why don't you? If it's not admitted as evidence then the presiding judge can't take it into consideration, therefore it is not prejudicial to Lindsay's case.

God there are some stupid people on this thread... Things that TMZ has been accused of or has been said here by the stupid people:
1. TMZ never reported this was cocaine. For the idiot on page 2 or so saying TMZ is crap because this isn't cocaine in the picture - THEY NEVER SAID IT WAS, go back and look.
2. For all the idiots saying it's a cell phone - for the love of god, everyone pretty much agrees its a cell phone laying there, but there is a giant line of coke RIGHT NEXT TO A CREDIT CARD on the mirror idiots.
3. For the person saying this was a setup simply because the picture is in black and white - please go back to school and get some more education. You are stupid.
4. For the biggest idiot of all that gave a speech about how TMZ is run by uneducated people and Harvey, an inactive lawyer that appears to be "working for Fox news" - Do you realize how utterly STUPID you look trying to insult TMZ on a post about idiotic Lindsay Lohan? anyone who think that's not a line of coke is fooling themselves. I've magnified it as far as it could go without distorting the picture and there is a line ontop of the reflection of a line.

It can't be a credit card or a cellphone because it's just a single line. Even a credit card would cast a wider mirror image than a single line. The thinnest cell phone would look more 3 dimentional. There's no way to mistake a single thin white line for a cellphone unless you're high.

And lets face facts... She's in Cannes, she's partying with people that look like they are in their 40's and have refused to acknowledge that disco is dead... and Linsday has been tied to cocaine before.

We're not talking about a leap here. It's coke. The simplest thing to do is give her a drug test. Coke stays in your system for a while. So unless she shaves her head bald ala Britney... they can find usage as far back as 90 days in her hair follicles.

And good if they do. This girl needs help. We know she's done coke, we know she's partied till she passed out on many occassions, we know she's getting anorexic thin, we know she chased down some innocent drivers in a night of drunken road rage...

she's going to be an Anna Nicole Smith before she's 30 if she doesn't get help soon. So keep stickin it to her fairly or unfairly TMZ. Maybe she'll finally get real help instead of slaps on the wrist because she's a celebrity.

It's okay, I believe if it were a phone and a reflection Lindsay would have said so instead of saying she is being set up and knew who was behind it...and what radar online is reporting they have Dina on tape saying Lindsay was told not to leave Cannes until they had her warrant lifted...

Concerning her dad: a few years ago, Lindsay had said he was a loving father. She also said later that he was unpredictable - very common with an alcoholic in particular. The alcohol and problems made worse by alcohol makes them into Jekyll and Hyde, which is extremely confusing especially for kids. But remembering the loving part - my guess is that he really does want to help her, even though their relationship may not be in the right place for him to do so directly. He has personal experience with the justice system, has been in jail/prison, has detoxified/dried out, and knows from firsthand experience what she is going through now and what is in store for her if she doesn't change course. Based on what I've seen of her mom in that dreadful "reality show" Living Lohan and the atrocious stuff Mommy Dearest has said in public - I'm not so sure that her mom is as aware of reality closing in. She always seemed so delusional on that show. Lindsay has been on a self-destructive path since she turned 18, so the best I can say of her mom is that she seemed to keep a lid on that until Lindsay was 18 .... or at least public recognition of it.

Anyway - her dad knows a lot more about the reality at gut level than anybody else remotely connected with Lindsay. It's understandable that he's trying various ways to get her to take a detour, including public ways if Dina has been poisoning any chance of a relationship with his kids (as she undoubtedly has, based on her foolish public statements). He may be making a lot of mistakes and setting himself up for ridicule by the snarky public, but it's more likely that his motives are good.

I'm not sure how much Lindsay's "celebrity status" is likely to help her in influencing anybody in the justice system. She hasn't done much but lose jobs the past few years because of her unreliability, despite her undeniable talent. It's also not clear if she really has any money left, unless her Mommy Dearest did a lot of wise investing. She doesn't come from a "famous" family - her relatives are "famous" only because of her own work as a child and teenager, otherwise TMZ wouldn't waste space on them. She doesn't have the family connections or extreme personal wealth that prior trainwrecks du jour have had such as Paris Hilton, Nicole Richie, or Britney Spears.

I'm 41 years old and I have seen a lot of celebrity focused shows, papers and websites come and go. I thought TMZ was going to break the mold. But their coverage of Brittany Spears and now Lindsay shows they are just one step above the National Enquirer- I'll go back to reading People exclusively. Its too bad have followed you a long time but you seem to want to take a person struggle and push as hard as you can to send them over the edge by stalking them with your photags and multiple daily stories. There is no success in that no matter what you may think. Just cost you readers. I may be just one posting but I'm sure there are thousands that never bothered even to post before removing you from the bookmarks on their browsers.

I am not a big Michael Lohan fan...but he does seem to be the only one trying to make sure his daughter gets help...he would know what it takes...While it may be common practice to do some partying in your younger years, and most of us have been there done that…it’s my personal experience and opinion, that those that become hard core addicts with lifelong addiction problems or die from an over dose are those that have many enablers, with everyone turning a blind eye...and those with money and fame are more at risk. While she may believe her partying is innocent and everybody does it I can say that most people don't do it every night...and with a large amount of money at her disposal and the flame clingers...she probably does way more than the average person...

In order for this Judge to be PARTIAL and FAIR, she cannot pay attention to whatever news stories are out their, either from TMZ or elsewhere. TMZ has been fair to Lohan, they are just reporting on what the activities are of this former actress. For anyone to say that they're (TMZ) being unfair to Lohan, then MAYBE LOHAN needs to re-evaluate what she is doing in her personal life, not let it affect her professional life (too late) and get her act together, before it really is too late! Too Late Means, you are dead! And in Lohan's case she is doing everything she can to get their sooner rather than later!

Concerning a possible conservatorship: It's not too likely she has much to conserve... But in any case, it is unlikely that a court would appoint her father as a conservator because of his background especially, so y'all can stop accusing him of salivating at the prospect. But if she does have real money, a conservatorship is helpful because the court has very strict control over how the money is spent, the conservators have to account for every penny.

But so far Lindsay hasn't had the complete meltdown that Britney Spears experienced, so talk of any conservatorship is rather premature. Also no children are involved, which makes it all less of an urgent issue. Britney was really lucky that her dad was able and willing to put everything else on hold and be her keeper in more ways than one, any $$$ he's received for being her keeper has been a pittance compared with what he was capable of pulling in on his own. His relationship with Britney was good enough to do it, also - Michael Lohan just isn't in the same place with his daughter. Lindsay doesn't seem to have any trustworthy person in her family who can play that role. Her mom is the one I would worry about salivating for it, though - and the court might actually let her, which would mean same old same old.
