Lindsay Lohan -- Bench Warrant Recalled

6/8/2010 9:04 PM PDT BY TMZ STAFF

The bench warrant for Lindsay Lohan's arrest has been recalled ... a little more than an hour after it was issued, thanks to the fast work of bail bondsman David Perez.

Perez's peeps just posted $20,000 (the standard 10% of bail) in Judge Marsha Revel's court.   The judge recalled the warrant, which means she is able to remain free, though she has a tough road ahead.

If Lindsay violates the terms of the SCRAM program again, it's likely the judge will throw her in jail pending the July 6 hearing on the alleged probation violation for DUI.

In short, one more false move ... and she's probably going to the slammer.

Warning
Defendants who think that a bail bond is a get-out-of-jail-free card are mistaken. Bail bondsmen have the authority to get back their investment if you fail to show up for your court date. Getting sued, having your personal assets seized, or having a bounty hunter finding you and bringing you back are available options. Skipping a court date will not only affect you, but your family members as well, because whatever they put up for your bail will be forfeited

How many chances does she get, I mean it's always like "ok, I let you go this time just don't do it again." but she screws up again and the same "oh well just don't do it again" The rest of the world has to deal with the consequences, Lindsay should too.

Are you guys happy now??? You got your Lindsay proves she's an addict proof. Or do you? SCRAM is a technology and computer and is it foolproof? Can it tell the difference between alcohol consumed vs. applied using nail polish remover? We have a bunch of preliminary info and you want to put Lindsay in jail based on that. What about her clean drug tests? Did she take one this week? And, did anyone at MTV or the after party see her drink alcohol? Why aren't you asking questions like this. Most of you are not qualified to be on any jury coming to the conclusions you are stating here. Lindsay was in compliance with the drugs and classes as well as SCRAM and a false positive SCRAM along the way is not that unusual. Whether this is the case here or not and Lindsay drank alcohol or not can not be determined yet. The bench warrant is per protocol.

She is a sitting duck. Regardless of her private life she has roles in upcoming movies. Now every competitor can throw alcohol at her and putting her in jail so they can get her jobs.
I believe that she should go before the judge and ask to max. out the sentence. She will properly only serve 10% and then be off probation. People can live a good life without drivers license, but opposite people can endure a bad life being forced to live a lifestyle without joy and parties.
Her lifestyle sell movie tickets. She knows that, the producers know that, the media knows that. She must find a way to come off the probation, so all can get the economy going.

Some info on the SCRAM from California DUI Attorney 2009:

Problems With SCRAM Monitoring

There is no scientific validation that this device is totally foolproof.

The SCRAM device is not for use as a quantitative analytical device, nor was it designed as such, according to the inventor Jeffrey Hawthorne. According to Hawthorne there are too many factors that cannot be controlled, and therefore the SCRAM should only be used as a screening device.

Despite its growing popularity as a trans-dermal alcohol measuring device, there have been no complete studies on the diffusion of alcohol through the skin and according to Hawthorne, this is an issue that is still not totally understood.

Overall, due to the lack of thorough research and lack of scientific evidence to prove its reliability, it can trigger a "false positive" result. A “false positive” result is one where the subject tests positive for alcohol without actually consuming alcohol. The technology used by the machine has been shown to be non-specific to ethyl alcohol (the type of alcohol found in alcoholic beverages). What this means is that it is difficult to determine whether positive readings came from a beverage or from food prepared with alcohol. Furthermore, interferences in the reading can arise from environmental sources of alcohol, such as anti-freeze, wallpaper paste and other household chemicals such as solvents.

Another factor that complicates matters is that a device using a fuel cell, like the one found in the SCRAM tether, can also be triggered by internally produced alcohol. This means that Acetone produced by the body during the breakdown of fats, will cause the body to internally produce alcohol, resulting in the subsequent emission of alcohol. Diabetics produce a kind of alcohol which could be detected as interference. A number of foods including certain types of chocolate cake, apple walnut bread, raisin bread, sourdough English muffins, cause the body to produce endogenous alcohol which can give a positive reading on a measuring device. The machine may measure certain metabolic functions as alcohol thereby rendering a “false positive” as alcohol may be generated through metabolism as food converts to energy in the body.

Despite all the controversy surrounding the SCRAM device, it is widely used and approximately 23 states use the SCRAM device. It was first sold to probation departments in Michigan in June 2004.

While it may feel clunky and look embarrassing, it is eventually a 24 hour watch dog, one that can send a person back to court and back to jail.

well everyone is assuming she ingested alcohol while most of the ppl that saw her at the party said she didnt.plus a SCRAM can go off at the slightest detection of alcohol such as perfume some food and most everyday products and can be absorbed into the skin
